In 2007, I was arrested for 2 misdemeanor DUIs in different counties within 2 mos of each other when I was 18. I went to court for 2nd arrest 1st & was sentenced to probation, fines, com service, impact panel, & classes. Then at court for 1st DUI arrest, public defender told me I should have been offered supervision for my 1st offense because of Illinois DUI laws & mandatory sentences per DUI. I asked 4 jail time instead of probation because I was homeless & would not have any $ to pay for fines. Also had probation in a diff county revoked two different times for a misdemeanor destruction of prop&underage drinking charge when i was 17 for failure to pay fines & court costs/fees, but was given the exact same sentence as my 1st DUI. I know DUI laws have changed a lot since 07 just curious.

In 07, while I was 18, I was arrested for two DUIS in different counties within 2 months of each other. I ended up getting convicted of the 2nd DUI first and sentenced to 2 years probation, then for the 1st I requested jail time instead of fines and probation because I was homeless. I was declared indigent then given 2 yrs probation with almost 2k in fines. I became unemployed a few mos after I was ordered to set up the payment plan for my fine and havent been able to pay since. I cant get my license back without it and cant find work without reliable transportation. I am also a struggling single mother. I cannot afford to make more payments and need my license but it would take me years to pay it off. I am desperate for any help out there so I can finally change my life for the better!!!

No because supervision is not a conviction.
This was my first DUI, and hopefully last. I blew a .106 and after he went over the police report and DVD, he attempted to ask for a plea agreement with the prosecutor. He told me, that the police chief is really tough and doesn't allow plea agreements to be made so easily between prosecutors and attorneys. So now he is going to write and send in a mitigation letter with all my mitigating factors (.106 blow, I acted and cooperated during the arrest, etc.) and hopefully it would able to help me to get my license back and find a plea agreement. As I said, this is my first DUI, so I'm not quite knowledgeable about all this which is why I wanted to get feedback from this website.

I was pulled over for speeding in Kendall County, IL, after which I was asked to submit to a Field Sobriety Test. I remained calm and polite while acting in this, followed instructions, and acted to the best of my abilities. Due to the circumstances surrounding the issue (40 MPH cross-winds, my shaking based on the weather and my nerves), I was taken in to the station, in which I continued professionalism before agreeing to submit breathalyzer. The officer gave me 20 minutes to sit without coughing, touching my mouth, or belching (Avoiding coughing was impossible, as I was sick). In the officers' statement, the coughing constituted as a refusal to blow. What are my options, and does this circumstance constitute my "admission of guilt"?
