I was born and raised in Northern Colorado and recently received a DUI/DWAI for what I assume was being on my prescription medications. I assume this only because I never took a blood or breath test and never admitted to drinking. I work at a bar and am pulled over all of the time for what I feel is simply driving home late at night, which I don't believe is a crime. I am tired of the abuse that the law enforcement in my community is conducting. When my car gets stolen, I get no help from police. When I drive home from work I am lied to and asked to perform stupid pet tricks on the side of the road. I am now being admonished by my University even before I am convicted of a crime! Can I take legal action against my University for this? It ruined the end of my semester and all my grades.

I was recently arrested for DUI. I performed the roadsides "failed them" then out of irritation refused the chemical test. I told the officer I didn't know why I was pulled over and that I had nothing to drink. He told me that I smelled like alcohol (I drink NA beer). He made several mistakes like the direction of travel on the police report. Said he saw a box of beer that appeared to be empty (how does a box appear empty? It's a box). His report is very short and only contains exaggerated roadside observations which according to the NHTSA he did not even conduct correctly. I could go on and on. - My question is; Are plea bargains just a way for the State to get out of proving guilt to save some money? I would think in a refusal case it would be much harder for the State to prove guilt.

I was 18 years old at the time I committed this offense. I have not had any other offenses since 1978 (other than minor driving offenses, such as an occasional speeding ticket) and, in fact, for many many years have drank very little alcohol (two or three beers or glasses of wine per week). I am active in the community where I live and otherwise live a low key and quite life. I am a CPA and manage the tax department of a multinational corporate enterprise.
Unfortunately, no. Under current law you can not seal or expunge a DUI or DWAI conviction in Colorado.
I was pulled over for speeding asked to perform the roadside tests and tried to complete them. I thought I did what the officer asked, but evidently not. In the arresting officers report he describes my demeanor exiting the car as using my vehicle to balance numerous times. He also states that during the one leg stand and walk and turn test that I used an adjacent fence for balance more than 5 times. - Given that the officer indicates I was barely able to walk, the assisting officer does not mention poor balance in his report during the roadsides at all, he only mentions the so called odor of alcohol, slurred speech and bloodshot eyes. It was Finals Week and I pulled two all nighters that week and was EXHAUSTED. -I refused the blood and breath test because I was angry I was under arrest.

Sadly this is my second DUI in about six years. I actually refused the blood and or breath test because it was more likely than not that I had anti anxiety medication in my system and didn't want to give the officer any tangible evidence. I am a full time student at the local University and work about five days a week. I know quite a few people that have two or more DUI's and had to serve some sort of time, so I am expecting that's what I will have to do. Is it possible to get hire a lawyer and maybe get an ankle monitor or something of that nature so that I don't have to quit school or my job? What kind of action can I take to mitigate the punitive measures? I'm not looking for an easy way out, just trying to move forward without looking back. If I have to take this case to trial I will.
