I was arested for a non injury hit and run as well as dui over .08,both misdeminors. This is my first arest.
To put you in jail, they have to convict you first.
In some counties, judges impose a minimum of 48 hours for a...
I have 2 Dui's, I am still on probation for the 2nd DUI. I just got pulled over and currently awaiting charges for driving on my suspended license. I was driving to work, it was my first day of work. The officer did not impound my car nor take me to jail, however I do have a court date. My attorney said it is possible to get at least a no custodial sentence, but a huge fine. I got pulled over though in a different county, so as far as violating probation in a different county, and what could be done by mt attorney, is there hope?
If you have an attorney this question should be directed to him/her. This person will have intimate knowledge of your...

I was arrested in 2012, but my case is still in pretrial phase, no Motion to Suppress Evidence has been filed yet.
My question is whether Missouri v. McNeely applies to DUI searches in California prior the 4/17/2013 ruling? see Davis v. United States, 131 S. Ct. 2419 (2011)
Obviously there is no case law on that specific issue but I bet it does.
I got a dui November of 2006 which is exactly 6 years and a half ago. My insurance is super expensive. Can I go back to court and get it expunged or dismissed? No DUI's not violation of probation . since then .
You can go back and file for 1203.4 dismissal, but it wont really do anything as far as insurance goes. Even in court,...
