Currently on pretrial diversion in Harris county for a DWI i received last year, started the program in June. Made another bad mistake and got hit with a PI in Montgomery county this past weekend. Since these events happened in two different counties, any chance my community supervisor will not find out about the arrest? On Oct. 26, 2010 I was stopped for a DUI. No breath test or blood test were given. Transcripts and DVD do not match . Only state evidence was my admission of drinking 4-5 beers inside of 2 hours, then I ate while doing activities which lasted four and a half hours, then drove home when I was obsereved by a tropper under reasonable suspicion and probable cause swerving within my lane .I can go on and on about the lack of evidence, and I can prove the one witness against me lied on the stand as well as the location in which I pulled over all through the trial. I chose not to testify. Now I have been convicted by a jury of DUI. How can I justify an appeal? My step-son is an alcoholic. He has spent time in prison two different times for his disease. He is now in Montgomery County jail being offered 40 YEARS for his 4th DWI as a habitual offender: a blue warrant was issued so no bond. Granted, he needs help but the punishment doesn't fit the crime. I've heard all kinds of stories about the DA in our county going wild w/ punishment but is there a way to get him into treatment? Come on, this doesn't seem right/fair. His public defender forgot all about him last court date so he sat there for 9 hours in handcuffs. I'm beside myself w/ grief knowing there is nothing I can do.
