on 07/13/2013 I was ticketed for running a stop sign, which I promptly paid off online. Unaware to me, my license had been suspended due to a mistake by PennDot. This past weekend I was pulled over due to the suspended license when the officer smelled alcohol on my breath, resulting in a DUI. I was maintaining the speed limit and staying between the lines the entire time. Could the fact that my license was suspended without any notification (Received no mail from the DMV) and unjustly (as admitted by the district court) help me out of my DUI, since the only reason i was pulled over was for a suspended license? I'm unaware of what my BAC was, as i have yet to receive any mail from the police station. Thank you.
Interesting situation, but I highly doubt that the ONLY reason you were stopped was a suspended license. How did the...
Need some real help with appealing an underage drinking conviction in Columbia county. I talked to one Columbia county lawyer and he basically told me that i could appeal the conviction but i am basically out of luck. I am facing a 2 year license suspension. I know that i was in the wrong but 2 years is a long time and could really mess up the life of someone who commutes to both work and school. any advice would be appreciated
You are on the right track. You need to pay an attorney for his or her work hourly in preparing an appeal for you....
i received an under 21 DUI over the weekend and the first thing i was asked was not for license and registration but instead how much alcohol and marijuana had i used that night. i said none. shortly after i was asked to get out of car and given a PBT it was not until hours later (2+) at the DUI center after my blood was taken that i finally was asked to complete the field sobriety tests in some room. Also, my blood was taken at least 2.5 hours after i was pulled over isnt there some kind of rule about that. im looking for anything that could get my case dismissed my job depends on it!
The best thing you can do is retain a criminal defense attorney who specializes in DUI cases. There are many options...
i am 18 and from PA. this weekend i was pulled over a few hundred feet from my home because of a broken headlight. The officer asked me to step out of the car and breathalyzed me. i believe my bac was close to .14 or so. i was charged with my first under 21 DUI The arresting officer was actually very friendly and helpful. He explained the ARD program to me but i am worried i am not eligible because of 2 underage drinking violations from my past. i am also worried that i will be charged with another Underage drinking on top of the DUI (even though the officer said that wouldn't happen) All in all it was about 2 plus hours until my blood was taken and i have not received those results yet.
Retain a criminal defense attorney who specializes in DUI cases. You should qualify for ARD even with your prior...

I'm a hard working person, I don't do drugs, the kids have no other family to take care of them accept their step mom. Please help!
You need to sit down with an attorney. These are mandatory minimums, both the 3rd DUI and the DUI while suspended....
I have 2 2nd DUIs w/ a total 36 mo suspension. After house arrest,I will be living w/ my boyfriend in York count in a very rural area. I want to continue to work fulltime and continue with school (BSN) but he is a single parent, no where near any public tranportation & it would be an impossible burden. Is there any hope of reduction or type of hardship license? A way to get time served or credit some other way?
No. The suspension is mandated under the law. There is no means by which a suspension may be reduced. You may...
I live in Pennsylvania and on my record I have a shoplifting charge from 2007, a dui highest tier from 2009 and a second dui lowest tier from 2011. I know if you have ARD it is possible to have that individual record expunged (first dui). However, I am wondering if there is any way to go about having my other arrest records expunged or sealed. I am now aspiring to become a teacher and I would do almost anything to not have these mistakes be held against me when I go for employment.
Unfortunately you cannot have convictions expunged or sealed in PA except under certain limited circumstances and not...
