The first time I didnt know my license was suspended because two days prior I had just finished paying all of my fines n restoration fee, but when the cop pulled me over he said that it was still suspended. I thought it probably just didn't register yet. I just got pulled over yesterday for driving while suspended due to an unpaid surcharge of $79. I thought all of my surcharges were paid off because I did not receive a state check n they said that nj surcharge took it. They even sent me back 3 checks in the mail because they took too much. Im pregnant and I just wanted to knowing it was possible that I could get out of doing the 5 days in jail?
There's a 1-5 days jail term for this new charge assuming you're not enhanced due to a DWI or No Insurance conviction....
My 1st DWI was in 1999, my 2nd was in June of 2009, my 3rd was in December of 2009. I already did 6 months in jail for the 3rd so everyhing is done with all of them. I am going to try and re-open the 2nd for the 20 minute observation. I know I can win but the lawyer I had at the time did not try to fight it. The officer that did the breath test came in the room 3 mins. after the arresting officer left only to give the test. He was there maybe 10 mins. The times are in the Discovery. So what would happen if I won? Thank You
In Wisconsin, the current third would count as a second offense. However, I wouldn't hold my breath getting the...
The DUI was expunged as soon as possible , and I am applying for licensor as an RN in NJ . Must I disclose this prior DUI ? The NJ NOB says yes , but doesn't mention expunger , of course .
I do not know. A DWI is not a crime in NJ and unless they specifically ask about serious motor vehicle charges or DWIs...
someone called me today and told me they got either a dui or dwi, they were drinking and admitted to the cop that they were doing shots of rum, so they asked the cop what they should do for they were nervous and the cop said don't take the test, and they took person to the station and enpounded the car, they got the car back, what i don't understand is how will the law or can the law charge that person if they didn't take the test after the officier told them not to, now they have to go to court, find it odd that they would even have to go if they didn't take breathilizer, I feel that the officier would get in trouble for not taking one...any info would be appreciated
The officer can't tell someone not to take the test, but its unlikely the report will say that, which means it is his...
I recieved my first DWI in New Jersey six years ago. Recently i was arrested for DWI in PA. My understanding is that the ARD program is available for those without prior convictions. Because in NJ, 1st DWI is a traffic offense, will I still be eligible for the ARD program?
Is it a traffic offense, or a criminal traffic offense as in most states?
Hi, I recently received a DUI in PA, but have a NJ license. The judge took the License of others convicted who had a PA license, but she never took my NJ license. The question is am I aloud to drive still since she never took the license? I have not received any paper work or anything. I'm on the ARD program.
While I don't practice in NJ, you are presumably allowed to drive in NJ on a valid NJ license until NJ tells you...
first off i was driving my friends car (which he was intoxicated at the time) n his License was suspended ... so the cops ran the tags when they was behind me n pulled us over , they suspected drinking going on by the smell of liquor in the car (which he had an open bottle in there as well) so they had me get out to do the dui field sobriety tests which the cops claim i failed so they arrested me n took me to the station to take the breathalyzer test n passed .04 let me go .. which i have to appear for court but gave me 4 tickets for driving while under the influence of liquor or drugs, obstruction of winshield for vision, open container of alcohol , and reckless driving
It is my opinion that any time you are facing potential loss of license and other "consequences of magnitude" you...
