I was walking home to my apartment having had a good amount to drink (I'm 21). Before walking into the stairwell, I saw a friend and said "We should smoke pot later." Right when I walk into the stairwell that requires a key for entry, a cop is standing there saying "Oh you're smoking pot later?" and immediately searches me. Luckily, I had nothing on me. He continues to interrogate me and says I'm being "smart" with him (which were NOT my intentions) and arrests me and takes me to jail. Could I fight this in court saying I was not in a public place since we were INSIDE the locked building where I LIVE? I feel like I somehow hurt his ego and he was just trying to get back at me. I have an option to pay $179.00 and not appear in court. I'm concerned I could pay MORE if I try fighting it.

I was sick at the time of the arrest and had been for some time. i hadnt lived in lexington long so i was confused about the road names when the cop asked where i was coming from. i repeatedly told the cop i get anxious when being pulled over and was very nervous. he made me do 5 fst's including ABC's and counting backward from one number to another, plus the regulars. i took the breathalyzer at the stop and blew zero's but the cop told me my eyes were red even though i told him i was sick. he asked to search my car, and told me if he found nothing he would let me go home with no charges. he found nothing and still took me to jail. then i took another breathalyzer and blew zeros again, but i refused the blood test. in their videos i wasn't slurring stumbling and cooperative, can i beat ?

I was charged with DUI 3rd offense back in Feb. 2009. The other 2 were in 2004. I have finished all classes, paid all my fines, treatment, probation, etc imposed by the courts. About 4yrs ago there mother was pulled over with them in the car she was arrested for dui and wanton endangerment. Her attorney was able to get it down to wreckless driving but still had the wanton endangerment charges. She was pulled over again last month for dui and is still in the court process of these most recent charges. Thankfully the kids weren't with her but she was to pick them up the next day and couldn't since she was sitting in jail. I am wanting to know what legal steps we can take to make sure the kids are not in any danger. Can we do anything before she is formally charged? Given her record, will she lose her license or could she possibly do jail time? Are we able to do anything with her case and ask that she seek treatment?
