My nephew got his 3rd DWI driving my minivan, and my van is said to be forfeited, i am handicapped how do i get it back?
my Nephew was driving my van without a liceance (unknown to me) and got his 3rd DWI my van was impounded and told to be forfeited, its been two days and the arresting officer still has not gotten back to me on how to get van back. The deputy answering phone said they had to interview me about letting him use my vehicle, also mentioning i may get fined and may have to go to court in 30 days to try and get my van back. Now I desperately need my vehicle I am handicapped and have a major surgery coming up in days with quite a few dr. appts in these weeks between I have no one else that can take me, I live on a limited income and i am still paying for my vehicle i can not afford to get another and still pay for my van please i need help and dont know what to do.
That sucks, don't expect the police to help. You need a lawyer. The cops couldn't care less.

I was a passenger in my own vehicle when a citizen reported my car swaying in the lane. The driver turned into a McDonald's restaraunt and I took over the driver side to see the menu and order. Just then I looked in the rear view mirror and the red lights were on us. I was told to pull over to the side and me and the driver switched seats again. I was charged as the driver going all over the road and failed my field sobriety test. After reading the police reports from three separate officers, the reports have conflicting information about who was actually behind the wheel at the time of the stop. Also I was on seroquel which is a strong anti-pychotic medication. I did not do the intoxilizer. Does it sound like I may have a chance to fight this?

My husband recently was arrested for dwi, his only one in over 20 years after over 15 years of sobriety.
He had 3 prior offenses on his record from when he was young so license cancelled ips. he can get his license back if He does interlock. Since he is not working & had surgery that makes him unable to work at present he has not attempted to get his license back. If he waits out the 3 years of cancellation, does he have to have interlock anyway.he has completed treatment & has voluntarily attended outpatient treatment at least once a week as he feels it helps him maintain sobriety. He has been sober since his arrest & plans to stay sober for the rest of his life.
If he is cancelled IPS he will have to do the IID as a condition of getting his license back so he cannot wait it out.

So if you see a person stumble out of a bar and start driving and call law enforcement and he gets pulled over from that call alone he gets off because it's entrapment because he didn't break any traffic laws just that a concerned citizen is worried about public safety how can a person be legally drunk and get away with it what is the law .

I have an interview on Thursday, but currently have a pending DUI charge. It is pretty likely it will get reduced to reckless driving. Should I disclose my pending charge to them? If they ask about pending charges directly, I won't lie, but should I volunteer that information to them? I have no other charges or arrests in my life so I don't really know how to go about this. Why did I get my administrative penalty for "refusal to test", but still haven't gotten any criminal notice/penalty/court date?
At the end of Feb, I was driving drunk and hit a tree and was taken to the hospital. About two weeks later, I got an accident report from the police station that said that I admitted to drinking (while still on the scene of the accident), but when I was taken to the hospital that I "refused to test". Because of that, about a month later I got a notice from the DPS about my license being suspended for "refusal to test". It has now been a month since THAT notice, and a few days away from two full months since the accident. Why haven't I gotten any criminal penalties/court date, etc.? Is it possible I wont? (I ask because I don't want to go do everything I have to do to reinstate my license, including buying a new car/plates, etc, only to have new penalties, plates impounded, etc)

My boyfriend was sentenced today to 42 months for a felony DWI. My question is this - He has a pending case in Hennepin Co for 5th degree controlled substance. He missed the omnibous hearing because he was incarcerated in another county and is now off to prison - so can he do something about the hennepin case now ? Just so he doesn't have dealing with that to look forward to when he's out ? I thought they could allow him to plead guilty and have the time ran concurrent so when he's done serving his time he can be completely DONE ! Any one know about how to go about this ? PLEASE
