I have completed all. My attorney stated that since i already completed 18 months of Alcohol education on my prior, the was no req. for it on this case, nor was it stated on my sentencing sheet. I just called DMV, MAU and the lady, stated my license is revoked for 3 years which i know, when i asked what can i do to get it reinstated, she said 12 months of an 18 month Alcohol class, when i said my terms and attorney stated i didn't need to, She says,'Either do it or DON'T" (someone didn't get laid i guess) and hung up. I called my Alcohol class and they are sending me my completion on the second DUI showing i finished my 18 months. What are my options at this point? Any help would be greatly appreciated, the attorneys on this board are so knowledgeable. Thank you and GOD BLESS.

In January 2005 I got a DUI at the age of 17. In September of 2011 was arrested for DUI. I hired an attorney and in January of 2012 was charged to count one of VC 23152 (a); the rest of the charges were dismissed. I was ordered to complete the first conviction program -Alcohol education, pay court fines and remain on summary probation for 5 years. By the end of 2012 I had completed everything I was ordered to. My 2 year suspension was up Jan of this year and in preparing for what I need to do to get my license back, I read a dmv notice stating I would need completion of a court-specified 18-month or 30-month alcohol education program. My question is, if I was court ordered to the first offenders program (3 month), will the 18 month apply to me? I want to get my license back!!

i refused the breathalyzer at the scene, and blew a .08 at the station. The officer also took my blood as he felt i was under the the influence of other drugs. I had snorted a few lines a cocaine an hour before he pulled me over and smoked marijuana about 10 minutes before. The officer did not find any marijuana or cocaine in the car. I have spoken to a handful of lawyers and they have told me since my breathe test was right at the limit .08 and since this was my first offence they might be able to drop the charge down to a wet reckless. However, the blood test will show that marijuana and cocaine in my system. How will this affect my charge?
