I was charged with VC22152 But my attorney got it reduced down to a DRY VC23103 The DMV said I need to enroll in a 3 month DUI class to get a restricted license then I get 2 months added to my the restriction. I currently have a restricted license but am on leave for the DUI class but when I come back from leave to the DUI class this will be after my restriction period expired do I need to continue the class to get full license back? I am 18, in California. Last night, I got pulled over because an officer saw people drinking in the backseat (is this a valid reason to pull me over?). I was asked to step out of the car and preform a few tests, which I thought I passed, and then told to blow in to a breathalyzer. I blew a .07, a .01, and a .07 (this includes the 2 tests administered on the street, and the test at the police station). I was handcuffed and put into the back of the car, where I was left ALONE for about 5-10 minutes before being driven back to the station. Does this violate the 15 minute mandatory observation period? I am interested in finding out what you believe will come of this case? Will I be convicted? I understand all cases are different, but Im curious how things have turned out in similar cases

No prior criminal record. Currently I'm represented by the public defender. My two attorneys say they don't believe the DA knows about the other case (they both think I have no crim. record with no pending cases). In essence I'm being offered two different first time DUI offenses. Is this right? If I plead in one, will I immediately have a DUI and then when pleading on the second be pleading to a "second time DUI". My attorneys appear not to know the answer to this question. Thank you.
