I live in a suburb of Buffalo, NY, court will take place in the Town of Tonawanda. I refused roadside breath test but took chemical test at the station. BAC .14. I know this is not good for me at all, but I need an honest opinion of what will happen. Is there any chance I will be able to plea guilty of the lesser charge for a second dwai?

I was charged with DWAI in 2003, DWI in 2004 and most recently a DWI in 2011. Since my last conviction I have quit drinking, joined AA, landed a great job, been a great father to my 2 girls, got engaged and started a business and will be buying a house in May. Basically I have turned my life around. The only thing missing is my license. The new legislation passed on Sept.25th will keep me from driving until I am eligible to reapply in 2017. My lawyer who represented me in my last DWI claims he cannot help me get my license back and suggested I try another attorney. The lady at the DMV suggested I get one of my DWI's taken of my record. I have hit a wall and need some help. Can you help me?

I was drinking soju (Korean distilled rice alcohol) with a alcohol percentage of 20% while eating Korean barbecue (I ate quite a bit). I had about 10 shots from 7:30 pm to 9:30 pm. I got pulled over at about 9:45 pm and blew 0.127. I didn't feel that drunk but obviously the results are what they are. After being processed, I agreed to take a blood test at about 11:30 pm. Do you think my blood test will show a lower BAC?

I received a DWAI in 2005, a DUI in 2006 and most recently 2011. I have since been to rehab and quit drinking for good. Im a great father to 2 beautiful daughters, run a successful business and have really turned my life around. The new laws in NYS make it impossible for me to get my license back at this point forcing me to wait until 2017 to even reapply. It is hard to deal with the fact that I will not be able to drive for most of my daughters young chiIdhood. I have not had my license for over 18months already and want to know if their is ANY way to drive. Thank you for your responses in advance.

How often do you see jail time when defending such cases? No accident, blood alcohol of .14. I know it is ultimately up to the judge, and how well my lawyer presents my defense, I am just curious of your cases.
