I plead guilty to a dui (from prescription medication) six years ago. I am now being charged with a 2nd dui (also from prescription medication) with an accident. The cop did not take my license and the DMV did not suspend bcz of the 2nd dui. The judge is offering a deal where I plead guilty to dui but I am NOT required to attend dui alcohol school since I don't drink & the dui did not involve alcohol. If I accept the deal will the DMV suspend my license? If so, can I wait out the entire 12 month suspension to avoid attending a dui school? Any way to avoid attending an 18 month alcohol program since I don't drink and neither dui was as a result of alcohol?

Police pulled my blood out to measure BAC. The BAC is 0.08% but it has different blood type of mine. The blood type of the sample is B and mine is O. My attorney convinced me to drop the case at that time, he failed. He suggested me to agree dry reckless that DA offered but he failed again after meeting DA. Finally I reached agreement to Wet.
