So my ARD is over. I completed everything except am alcohol evaluation at a state certified place. On my online docket sheet it says adjucated and penalty satisfied. I was recommended that I do the evaluation and tell my PO the results but if I already signed off on my completion of ARD do I really need to? I don't want to waste the $100+ to do this unless necessary. I signed my papers and under my online docket it says penalty satisfied. Any opinions? I'm not trying to skip out on something. I have it scheduled next week. Just looking for knowledgable opinions. Thank you for you time.
Most often when someone gets a dui or even gets a dui reduced to a reckless driving, that person must go to dui school...
I have been on ARD for a misdemeanor DUI over a year ago. My last meeting is tomorrow where I'm supposed to sign my discharge paper however I do not complete the alcohol evaluation. My fines are all paid. My license suspension was completed. I did the safe driving classes and everything else except that one thing. Will my PO arrest me tomorrow or violate me. I'm really worries. I have the evaluation scheduled for next week. I just now got the money to do it. Not making excuses. Can anyone offer any advice at all? Technically my ARD isn't up until Thursday. Thank you for your time.
He cannot arrest you, but he can file a petition to remove you from ARD. Hopefully he will allow you to get this done...
son wrecked, left the scene, officers came to the house, he admitted to them that he was driving the vehicle, he was taken to the hospital and arrested for DUI. Just want to know if the underage charge should affect him being accepted into the ARD for the DUI. He is just graduating college & looking for a job & made a stupid mistake, that I really hope does not ruin his entire life
It's considered a second offense. Depending on his BAC it's either a 30 or 90 day minimum mandatory incarceration...
The cop who arrested me for a DUI is no longer a cop. A different cop is trying to charge me and he wasn't even there.
The short answer to your question is YES. It is actually quite common for charges to be filed "on information," meaning...

Hello, I was arrested on October 7th for DUI. This is my first offense. I was taken back to the station, given a breathalyzer test and released. My Preliminary hearing was on January 14 and I waived it. I signed the waiver of the Prelim and for Counsel. I scheduled my Court Reporting Network Eval that day and completed it on February 5th. I a scheduled to appear for Formal Arraignment this upcoming Wednesday, February 13, 2013 at 8:30AM. like I said, this is my first offense in PA and I would like to be accepted into ARD. Am I able to waive my formal arraignment in this case? How do I apply for ARD in Armstrong County? Can I waive my formal arraignment on the morning of the arraignment date? or the day before? Thank you so much for your help!
Arraignment can be waived but it is strongly urged that you secure a criminal defense attorney to represent you. There...
1 and a half years ago i was stopped for speeding. a month later i was charged with a dui in pa. after 3 continuances because the office was sick it was dismissed at the preliminary hearing, the offcer got better and refiled charges. my attorney made a motion that it be dismissed because it went over 1 year (rule 600) it was denied. also another motion because the officer had no written permission to refile the charges (rule 544) also denied. now we are going to trial and the officer keeps trying to get intouch with the person that was in the car with me. my witness. is this normal?
Whether it is normal is not the important question. Whether or not the passenger is required to speak to the officer...
