Charged with DUI while pulled off the road with a flat tire. Blood test was not administered within 2 hours of driving.
My front right tire blew out, causing me to go down onto the berm of the road into mud. I was able to drive further up the road and pulled off the road into a private drive. I shut my vehicle off and called my husband to come help me with the flat tire. As I was waiting a local officer pulled behind me and approached my window and which time he smelled alcohol. He then contacted state police to perform DUI tests. According to the report the "accident" occurred at approx. 8:40 which is probably when the officer pulled up behind my disabled vehicle. The blood was drawn at 10:40. Is this considered within 2 hours of driving? The "accident" occurred well before that, as my husband finally showed up right after the local officer. Can I fight this?

So my ARD is over. I completed everything except am alcohol evaluation at a state certified place. On my online docket sheet it says adjucated and penalty satisfied. I was recommended that I do the evaluation and tell my PO the results but if I already signed off on my completion of ARD do I really need to? I don't want to waste the $100+ to do this unless necessary. I signed my papers and under my online docket it says penalty satisfied. Any opinions? I'm not trying to skip out on something. I have it scheduled next week. Just looking for knowledgable opinions. Thank you for you time.
