I was automatically recommended for an ASSESSMENT based solely on the fact that this is my 2nd DUI . Do they have the right to recommend me to an assessment for a possible 12 week program based on something that happened 20 years ago? Shouldn't this be treated as a first offense? Extra info - in the past 20 years I have a spotless clean driving record and no other arrests.
It likely was sentenced as a first offense because of the ten year stepdown but it is still a 2nd offense. The IDRC is...
First offense DUI and refusal to take breathalyzer
The only person who can tell you how much time you will have to serve is the Judge when they sentence you. An...
for two years. Since I was suspended in NJ for only seven months, I thought I could get a license in NJ. Now DMV is telling me that I cannot get a license here until I get a letter from the OTHER state. Can DMV in NJ impose this requirement?
Yes. They can. NJ is one of 45 States which is part of the interstate compact. They will treat your prior DWI as if it...
I was home sitting in my car in my driveway n 2 cops pulled up and said they got reports that I hit multiple cars. .. By the look at my car it was clear that it was BS as my car was not damaged yet they charged me with DWI. I was home already in my house drinking I decided to go back out to get my cigarettes and I made the mistake n sat back in my car with the keys in the ignition. I did already get a lawyer n explain the case - he thinks it's a tuff case - what do you think?
I don't know enough to comment. I must defer to YOUR LAWYER, the lawyer you hired and who alone possesses more...
Interlock device and restricted licenses
Still pending. I would not count on a new law very soon.
I believe that under NJ law this applies to an arrest made in a school zone. I have the police reports which indicate I was not in a school zone. Can I get my suspension reduced?
I do not believe so. Under our current court rules, the PCR (Post Conviction Relief) motion - the one that allows you...
My 20 year old daughter was arrested by a State Trooper. She took a breathalyzer but I do not know the levels, as the report is not yet complete. She was also cited for careless driving, improper lane change and underage drinking. She's never been in trouble. She was driving a car in my name and is listed as an insured on my policy. Should I get an attorney, or would it be a waste of money? I'm currently unemployed but hear public defenders work for the State and not to use one. I'm also very worried about my insurance being dropped. If she surrenders her license until she can afford her own policy, will my rates still be high? I have an impeccable driving record.
You should RUN, not walk but RUN to an experienced DWI defense lawyer. You should LOAN your daughter the money for a...
