I was arrested for DUI, I hired an attorney and after he review my arrest file he noticed that the officers DID NOT document the time the breathe analyzer test was given. He told me that he has to be given within a specific time period. Can anyone explain this more? Do I have a chance for dismissal?

After my dui was dismissed without prejudice and when i received my license back, I started driving. I bought a car, got car insurance and everything was fine. But after 3-5 months my insurance company called and said that my license is still suspended on the government website and they can no longer give me insurance. They said that I need to go to or call the district court (on Alakea street) and ask for the paper that states proof of lifting the suspension on my drivers license. I don't think I should do that because they may serve me my papers for the DUI (since it was dismissed without prejudice). I'm unsure if I should call the DMV or ADLRO. What should I do?

I got a DUI in Hawaii I opted for blood draw 3 hours later it was taken, it came back at 0.10. However the license was returned to me in mail because the ALDRO stated the arresting officers Sworn statment was missing, Which indeed my File copies do not have it. I have the sworn statement from a transport officer., arrest reports, but no AO/SS. However i still face court in 2 weeks. Can i have it dismissed based on this proof?

On 1:10 am. I blew .126 in the mobil road unit. At the station I requested the blood test instead of main breathalizer.. On 4:10 am. my blood was taken from a Med tech at the Main station. After chugging water,peeing, sweating,vomiting up water,and chugging more, My bloodtest came back next day at .10 .After 3 hours of full burning. This seems impossible. What do I have the lab look for when retesting my sample. What kind of things can get the case dismissed?

At 1:10 AM. I blew in a road unit breath test. Blowing .126 I was arrested and opted to take the blood test instead of main breathalizer. . During holding I was pounding water, throwing up and pounding more. I was pacing and doing pushups to sweat, thinking i had only precious minutes. At 3 :45 I was transfered to the Main station where a private, on-call med-tech took my blood at 4:10 Am. ( I have all documents). My blood result came back 0.10. So in 3 hours of drinking water and sweating my BAC went down only .026?? that's impossible.. The human body burns .01-.03 pr hour ( or one drink ) according to online studies.. How do i fight this point?

I got a DUI.. 3 days later i got a letter saying my license is being returned and processes being rescinded by the ALDRO due to insignificant documentation..Mainly the Arresting officers sworn statement. Which indeed is missing. Also his field sobriety test says not under medication but indeed i was and do have at time a Xanax prescription. My Road Blow was .126 blood draw 3 hours later was .10,? I was charged with a DUI in 2008 and it was dismissed without prejudice. Today, I went to the Traffic Abstract office (I recently got a new job which required a traffic abstract) and they informed me that my case was still open. Apparently, the charges were re-filed in 2009. I was not served with a subpoena and I had no idea that anything was amiss. Now, I'm concerned that the "active" status of my case will affect my employment. Note: my job simply requires that I have access to a car. I will not be transporting people (I'm not sure if that fact matters).
