As a part of a conditional discharge "a friend" was required to install and utilize an ignition interlock device. There was no requirement to abstain from alcohol. No condition stated that one could not receive a positive reading on the device, only that it must be installed, not be tampered with, and no other car could be driven. However, at the end it stated that "failure to comply with any of the above conditions or any attempt to start or operate a motor vehicle after consuming alcohol" would cause a violation. But if one has no intention to start the vehicle (they just want to see if they have a low enough BAC to drive), would this constitute a violation? Would intent to start or operate the vehicle be presumed? Is "after consuming alcohol" too broad?

my ex-husband had many unpaid tickets on his recorded so his license was suspended. He then got pulled over and arrested on a DWI and AUO in the 2nd degree, since then he has had court twice and has received another AUO ticket. He has to undergo an alcohol evaluation, but I was curious as to what other possible outcomes he could be facing, he thinks this is a big joke and he will get off with community service (he is still driving around, and even drives to his own court appearances, as well as drinking and driving still).
***sigh*** What can you do, some people just have to learn the hard way.
he thinks he will have to serve 10 days in jail. is there anyway to prevent that?

long story short;jan 20 i was charged with reckless driving per an anonomous tip,i failed several sobriety tests and they got a blood sample, 50 days later they called me to come in and charged me with the dwai,i admitted to having taken my presciption meds and that was why i was "impaired",true but one thing i did not say is that i had also taken a nonprescribed atavan.i got a letter a few days ago saying that if i sign a waiver to the speedy trial and get an evaluation from the county dwi assessment office that i have a chance to have these charges reduced.i am really poor so i have to go to my first court date unrepresented .what should i do is my question , i dont want to be put in jail because i am a single dad with a 5 year old daughter and i know i screwed up ,any advice would be a

hospital for a blood sample and had my van impounded and took me back to the station . . they kept me there for an hour then let me go , giving me a ticket for reckless driving . i was polite and respectful the whole time . i have 3 prior dwai's over ten years ago . i am on controlled substance prescription meds and took a little diazapem that day that i am not prescribed . . i am very worried . my court date is on April 9 , and i haven't heard anything further . what is going to happen to me and what are my options for defense ?
