Medical/Marijuana laws. The case that got me thinking about this just concluded, but I still wonder.
The defendant was convicted of a DUID. They said he had 10 nanograms in his blood and that was above the legal limit. Who decided that that is impaired? I know this man (very small area) and know he has been smoking for at least 20 years and is a 200 lb man. How does that compares to a kid who has just started smoking and is 130 lb? He is a "Red" card holder and as a condition of the PR bond was told to not partake in illegal drugs and had him take pee tests. Marijuana being legal and him having his card he continued to 'medicate.' All tests were positive. They withdrew his bond and gave him 30 days jail, and 11 mon. of alcohol classes stating that it is still illegal federally and that's what they are following. Then I see a protest on the news and the joints and officers. Curious

My boyfriend was pulled over for DUI in Colorado but had nothing to drink, is there any grounds for arrest?
The officer said failure to signal then gave him field test but no breathalizer. He had flip flops on so he had to do it barefoot on glass and rocks. Then they dont tell him anything and arrest him with no rights being read. He submitted a blood test and spent the mandatory hold of 16 hours in jail! We have no copy of the police report and they said it takes 2 motnhs for the blood test to come back! First of all if you are not read your rights can the case be thrown out? This man has absolutely no criminal history! Second no breathalizer...no grounds? This was a power hungry city cop. We need some serious advice. Can we request a copy of the police report? Also does a DUI blood draw kit just test for alcoohol or test for other substances.
