I live in California and am currently on probation for an OWI 2nd offense that I received in Michigan. My license was revoked for one year. Is it possible to win my Drivers License appeal hearing if I am still on probation? I hear this is very hard, but by the time I file for the appeal I will have 15 months of demonstrable sobriety, including voluntary testing beyond what was ordered by the court, and I can produce notarized letters from others testifying to my sobriety. I also attend AA, counseling, and alcohol programs. I have no probation violations of any kind, and I am serious about my sobriety. What are my chances of winning my appeal and getting a clearance? Tested clean for the last six months and got accepted into the University of Arizona Business School for Business Administration. I have an abscond 2 warrant out of the 6th Circuit Court. It stems from a 3rd offense DUI charge, all my community service has been completed, all my fines and costs have been paid, I've done a year in Oakland County jail (with good time) and I spent almost 5 years on probation. Everything was going fine and my P.O. was about to recommend I be released from probation, then I got switched to another P.O. and he didn't see things the same way. After 2-3 months of dealing with him, I just left the state like I had planned to do once I completed my probation. I didn't refuse the breathalyzer test; however, the officer requested the EMT to draw my blood without a warrant and against my consent. The ambulance was already at the police station for whatever reason and both EMT's asked me if this was a voluntary test and I repeatedly said it wasn't.
