I had a DUI in Oct 2010 and another in Jan 2011 and went through a sobriety program which I finished in record time and have remained 100% sober since. I have not had one drop of alcohol in almost 3 years. One of the requirements of the program was to have an interlock device on my car. Well I was driving about a year ago and the device failed with an error message so I called the company. They told me to drive to their location, they said they had to disconnect and reconnect it and it would be fine they would just document it. However, as a result of this the Secretary of State suspended my license as a result. They believe I disconnected the Smart Start even though I have record from Smart Start that they disconnected it. My license is now suspended for another 2 years.
First I recommend that you hire an attorney. Second if you wish to handle this matter without an attorney make sure you...
My son got a DUI in jan 2013 and was off probation in July 2014. He still has the interlock device. He is applying to the state to get his license back and the annual report from his device shows a .03 back in July. He was able to start it two days later without it being serviced. Does that mean it was a false positive? Should he even try to get his license back ? Will that be a guaranteed denial ? He doesn't care if the keep the machine in he just wants to drive where he wants and have less restrictions. He indicates he hasn't drank since his arrest. Sounds like if he is going to submit the paperwork to the state he will have to admit to drinking.
I would kindly but strongly recommend your son consult with a lawyer who handles a lot of AHS cases (used to be called...
we were pulled over i was in the passenger seat and said i had been drinking and got an MIP but they didn't give me any type of test is this a fight able cause?
Your admission is damning, but it depends on whether proper protocol was followed. Hire a lawyer from here on AVVO and...
I was driving several hours after drinking but was lost because I was out of state. I fell asleep at the wheel and totaled my car. No other people or cars were involved. I lost my driving privileges in Ohio but the Ohio Patrol said to contact a MI attorney to verify if I still had driving privileges in MI.
michigan and ohio sometime share information on driving records. what you should do is contact the secretary of state...
I am on probation for my 2nd dui & have 3 times where I did not pass my in home breathalyzer the 1st time testing, I have my POV hearing next week in the 47th district court. I am working a 12step program, go to counseling, have a full time job, go to school, paying my fines, & have been doing my community service. I am scared of going to jail.
You NEED to have an attorney with you when you go. Plead not guilty and only discuss the case with your lawyer....
I fell asleep in a cab and received public intoxication charge. I have been doing well on my 1 year probation. The last hearing the judge discussed letting me off early. Last night I was charged with a DUI for falling asleep at a stop light. I had a .14 BAC. How should I proceed? What is the worst case scenario? Best case scenario? Any advice? :(
Call an attorney ASAP. You are clearly headed for an OWI charge, and possibly a probation violation on the public...
I'm getting ready to file for an Administrative Review from out of state(3rd attempt) and I thought I had all the necessary pieces for a good case. But I've found out that my AA sponsor has relapsed during an ugly divorce and got a DUI. I have a great letter of support from him, but am concerned about his credibility now. I've put in a lot of work with him over the last 18 months or so and would hate to have to start over. So what are the chances of the DLAD finding out? Would they actually call him and ask about his sobriety? If so, will this ruin my case? Also, I haven't been getting an attendance sheet signed because I'm involved in a group where we are all close. Are support letters indicating my weekly AA attendance enough or is it better to get signatures for previous meetings?
You are not required to to attend AA. The Administrative rules says a petitioner may present evidence of a structured...
