I was charged with a 3rd (felony) dui because of my prescription medication on April 13, 2011. The officers did not conduct a field sobriety test, nor a breathalyser/blood test to confirm their suspicions. The charge was then indicted by the grand jury November of 2011 in De Soto county MS. I entered my plea March 7, 2012 of not guilty, and was assigned a trial April 2, 2012. I appeared this day and the following two days without ever receiving a trial. I was appointed a public defender on March 7, 2012 as well, who did not ever inform me of any other proceedings in writing after this, and during this. I was informed yesterday by a family member that there had been a court date March 18, 2013 without written notification to me. I was told there is a warrant for my arrest now.

They tried to serve the subpoena last week but I was out of town. They asked when I would return and my husband told them. They have not been back and the trial is tomorrow. We were hit by a drunk driver but did not press charges. Do I have to appear since I was not served eventhough I know about the trial?
No. If you have not been served the subpoena, you are under no legal obligation to attend the trial. However, the...
