She was pulled over for being on the wrong side of the road on a rotary. Does she have any reason to try to fight it or just try for Wet reckless. They also suspended her liscence in NH. Does that mean her liscence is suspended in MA where she lives. It was last Thursday and she has not gotten any correspondence from NH as of yet. Thanks for your help.
Because her case was in NH, you should change where you posted this to NH for some of your questions. As to the...
I was arrested twice in mass for dui ( continued without a finding and not guilty on each) and was convicted of dui in nh, can
I was arrested on 2 separate occasions for DUI in Mass. One was continued with out a finding and the second was found not guilty. I was then arrested in NH and found guilty . I was under 21 on all three events and all were more than 12 years ago. I no longer drink and am looking to obtain an FID or LTC in Mass for target and hunting purposes. is this possible.
You should review M.G.L. c. 140, §129B, to determine whether the prohibitions or restrictions contained in that...
Im wondering if there is anything i can do about my charges was originally arrested for 2nd dwi but lowered to driving to endang
was arrested for 2nd dwi but lowered to driving to endanger cause they new they were wrong says it all over police report but still have to pay all consequences of a 2nd dwi how is that right and is there anyway to fight to get my license back when under my understanding driving to endanger is not an arrestable offense its a misdemeanor and issused a citation?
I'm not sure I understand your question. First of all, driving to endanger is an arrestable offense and carries a 60...
Is there any way I can get around a prior OUI offense and obtain my license to carry a firearm in the state of Massachusetts?
I was arrested and convicted for OUI in Massachusetts in 1997. This was the only time in my life that I have ever been in trouble with the law. I am now a law abiding citizen and would like to obtain a License to Carry a firearm (class A) for all lawful purposes. Mass law indicates I will never be able to obtain this. Is there anyway I can get around this? I don't even think this was a law at the time of my offense! Do I need to hire an attorney to fight for my right to bear arms??
There may be a number of ways to legally obtain a License to Carry. A full answer would require analysis by a qualified...
Seal or expunge record of DUI arrest from CORI, and remove record of arrest and refusal from RMV record
I was charged with DUI in Mass. in July 2012 but am Conn. resident with Conn. license. The officer was found to lack probable cause, the stop was ruled illegal, the motion to suppress the stop was allowed, and the case was unconditionally dismissed with prejudice (it cannot be later refiled). As the stop was found to be illegal, would I have any avenue to expunge record of the arrest from my CORI and my RMV record? I think RMV should not retain record of a charge that did not result in a conviction or even admission of sufficient facts. Also, RMV has a record of refusal. Would being asked to take the test to begin with also be "fruit of the poison tree"? Given this, if expungement is not available, comments about sealing are welcome. I have no convictions or other pending cases anywhere.
In Maryland, D.C. , or Virginia, this case could be expunged . The charges DUI charges were dismissed so there is...
Is there anyway from getting it expunged or sealed from my driving record? I know that I can get my CORI sealed since it a cwof Dui and the Cori laws have changed. When it is sealed through the Cori does it automatically seal the driving record also? I want to know because of future employment I do not want employers checking my criminal record and nothing showing up but the DUI showing up through my driving record, which would it look like i have been convicted.
You have posted this question twice. Please see the responses to your first post. The case will remain on your driver...
