Is there away I can beat this DUI or get a lesser charge by this being my first offense
I got pulled over last night I passed all the test they have you do when they try to make sure your not drunk but I refused to do the breathalyzer so they took me in. They had me blow in this big machine and got my alcohol level. I did have a few drinks and I let them know that my license are also suspended the only reason I was driving was because my friend whos car it was was drunker then me she hit something and I got scared because I was in a bad car accident so I told her let me drive the rest of the way home. Im in school I work and I was working towards getting my license back I actually only have a couple more tickets in Detroit to pay and ill have my license back. but they wrote me a ticket for DUI and Driving on suspended license I go to court Wednesday.
Anything is possible but a lawyer cannot properly assess your options based upon this limited version of the events....
I received my 2nd OWI nearly 3 years ago. Can representation get my license reinstated without going to state board?
i have paid all fines and probation responsibilities within allotted time. I just don't have the time because i have to move in a couple months.
You need to contact a drivers license restoration attorney. I recommend attorney John English. You can find him on...
Should I attempt to reduce sentence?
I got pulled over in novi, MI. For speeding/dwls (1st offense), A few days later I got a owi(3rd). Well when I got sentenced for the 1st offense dwls they gave a recommendation of 2 years of probation and 5 days in jail. Well I tried to plea, and I got 1 year probation, 12 weeks counseling, a black box in my car, Testing on a driving simulator, 50 hours of community service, and I ended up paying $1350 in fines/fees. when I got sentenced for my owi I got into a sobriety court program, that allows me to have a restricted license and extensive probation ( weekly therapy, work program, AA, meetings with judge and probation officer ). My question is... Since I'm doing all of this stuff for my sobriety court, should I try and get my overkill sentence reduced for the DWLS?
Are they in the same District Court? If so, you may have a decent chance of getting the two probations "consolidated,"...
How bad would dui look to an employer compared
To other charges such as theft, fraud, assault or simple possession. I have a dui under controlled substance charge. I do qualify for a diversion program and will be able to expunge it in a year but in the time being how bad will a misdeameanor charge (not conviction) look to an employer?
It is going to depend on the employer. Generally, felonies are worse than misdemeanors and convictions are worse than...
I was walking drunk and some cops drove me home, I believe they kept my drivers license but I woke up with no ticket.
The ID was expired but I had the document for temporary drivers license. * Also I'm not from Detroit I live in Canada but it would not give me the option to write that. Would the police have just taken my license to throw it out since it was expired? Thanks
It is hard to know what a police officer might do, but they should not have thrown out your license, expired or...
OWI Forfeiture/Nuisance Abatement Trying to decide whether to pay $900 to have my vehicle released or to contest.2nd accusation.
This document says I can pay $900 or contest. The no brainer says I should contest. However, if I lose my OWI hearing, seems like I will also lose my car. I am very confident that I drank within the legal limit....but what if this...? what if that...? what if the judge...? what if the cop says...? Is this black and white? Either pay up or lose my case and my vehicle due to a 2nd possible OWI?
This is a situation where a direct consultation with qualified counsel will be of great assistance to you (and you're...
Michigan OWI. Refused breathilizer and blood test. Wrong driver's license # on search warrant for blood. Throw it out?
2 officers observed me perform dexterity sobriety texts, then 1 asked that I take the Breathilizer. I refused and was put in handcuffs. As 1 officer cuffed me, the observing officer proceeded to tell him it was the wrong thing to do (just thought that was interesting). I refused a blood draw, then asked to speak with my pastor (religious reasons) and lawyer beforehand. This was refused. A review of the search warrant for my blood reveals an incorrect driver's license number, an incorrect vehicle description (wrong color, which is funny considering I was stopped for being accused of running a red light) and a claim that I was advised my rights for a chemical test, NOT that I refused. If I never refused, why the need for a warrant? Just my thought.....
Refusal can be express or implied. Unfortunately many officers interpret nonresponsiveness or indecision as refusal....
