I was arrested for a felony dui (kids under the age of 15 in the car)in July, plead guilty to a misdemeanor and a class 6 open
I was sentenced to 18 months probation. I just rec'd a letter from the dmv stating that my license is revoked for one year and I'm not eligible for a hearing, even though I requested one in a timely manner and was scheduled a hearing for later this month. The letter also states that I am not able to have a restricted license. Is there anyway I can fight this? I really need a restricted license to get to and from work.
A DUI case is actually two cases that can sometime have conflicting rulings. Sentences handed down by court judges in...
Tucson, Arizona I refused to do FST. Made no statement. Submitted to blood test. No results back yet. I pissed of the arresting officer while being polite as possible but at least my car wasn't impounded. He decided instead of releasing me as has happened to many of my friends that I need to be transported to jail and held until 12:30 the next day. While in processing I requested to be released so I could do an independent test and ended up spending the rest of my time at pima county jail in a separate holding cell until release for being "loud". I also have a question about whether I should have been being record while I was afforded the twenty minutes and yellow pages to call as many lawyers as I wanted at 2 in the morning.
If you clearly and affirmatively invoked your right to an independent test immediately after being advised of the right...
I was wrongfully charged with a DUI in AZ Jan of 2012. The statute of limitations is passed on the case by 6 moths but they still filed charges in July. I have a court date Friday. I was wondering when I go into court and point out it has been 18 months and the judge dismisses the charges can I be charged with a felony related to this case? That way the prosecutor can avoid the statute of limitations or would that be double jeopardy?
Your public defender will advise you. Listen to him.
Last night I was arrested in my own driveway and charged with a DUI (no BAC reading yet due to the fact that the machine was not reading and they drew blood). I can't really guess as to what my bac was but I was definitely not in the extreme arena (I had 3 beers, and was extremely cooperative and coherent with the officers) I was unaware that my license was recently suspended until I attended a TSS class for a previous moving violation. My car was impounded and I was told I would be unable to reclaim for 30 days. My question A) Do I even have a fighting chance of reclaiming my vehicle and getting through this situation without a lawyer? B) I'm on very limited income as a single mother, are there options for payment plans with DUI lawyers? will my case be treated with less regard if so?
Any one, in my opinion, who is charged with a crime needs an attorney. Go to court as scheduled and ask the court to...

not need to appear. Is that true in the state of az

Got a second DUI in last 7 years, 3rd overall, also had cocaine in my system, what am I looking at in AZ
I was coming back from a friends house, I had a few drinks, got pulled over for speeding. I refused all tests, was arrested for DUI under suspicion, they got court order to do a blood draw which will show alcohol and might show cocaine. When I asked to speak to a lawyer the police officer told me they had no way of getting a hold of one and did not give me anytime or a yellow pages to find one. When I asked to go to the hospital for the blood draw, I was also refused, even after stating my fear of needles. Please advise

It was my first dui a year ago in September of 2012 and I don't have a car. If I get a car do I still have to get an IID? If so do I need to get an IID installed to get my license?
Check with DMV to see if you can get the period to start running. In CO if you sign a form stating you do not own a car...
