I blew .07, under the legal limit of .08 in Oregon. I wasn't arrested or processed. No fingerprinting or mug shot. My record is completely clean, not even any traffic citations. I'm 49 years old, and this is my first ever trouble. The officer stated I was very respectful and cooperative, and didn't want to put someone like me in jail at all. He even drove me home after I passed the breathalyzer. But he said he felt I was impaired, so he cited me, and I have to appear in court in a couple weeks. Wondering what my options are? I failed a BAC test and the officer issued me a implied consent form stating that my license would be suspended for 90 days. He had marked both the "yes" and "no" box on the form that would indicate if I was eligable for a temporary 30 day license. He did not have me sign the form. I had to go the police department and get clarification from a Sgt. He stated that I am eligable for the 30 day license and initialed the correct box. Is the form valid if I did not sign it? I went to a bar with a friend of mine and over the course of two hours consumed three mixed drinks. Upon leaving the bar my bumber lightly scratched another vehicle. I was unware that this happened due to my music being played loudly within my vehicle. Upon leaving someone wrote down my plate number and called the police. I headed home and my friend and I started taking shots of whiskey. I was home approx. 20-30 mins. The police showed up and informed me that someone reported that I struck a vehicle.
