I was given FSTs on a traffic stop for over an hour, same tests 5 or 6 times. On about the 3rd round, I realized he was going to keep doing them till I screwed something up. I told him I wanted to call my attorney and needed my cell phone (it was in the car). He told me I have to give a blood sample and can call afterwards from the station. I wasn't allowed to call ANYONE until after they jammed me with needles and I was officially released. When do I have a right to speak to an attorney? When he put me in the car to go to the police station, he read me my rights, which includes speaking with attorney, but how can I do that with no phone in cuffs? Do I have grounds for a motion because I was denied council? Thanks

Does this mean that blood draws that were issued without warrants can all be challenged? How will the courts determine whether or not a suspect "consented?" You really aren't given the option to refuse unless you want to take on cops in a physical fight.

Got pulled over for doing 35mph in a 45 zone between stop lights. It was 3:30am. Was taken in for a sobriety test and requested to speak to a lawyer before anything else to which they did not comply. Took blood for a sobriety test without consent and didn't EVER let me speak to a lawyer. Cop claims he didn't hear me but I requested a lawyer multiple times, very clearly and loudly. There are no dash cams in the cop cars, and no cameras in the PD station. It's cops word against mine, but the cop has PAGES of complaints online and is dirty.

Initial stop was for alleged traffic violation, but no ticket was ever issued. Blood drawn for DUI check instead. Does that have any bearing on the case? Also, cop claimed I had a suspended license which gave him the right to search and tow my car. No ticket or charge for that either, and my license was NOT suspended at all. It was a lie. So does it matter at all in any way whether he cited tickets or filed charges for the allegations he makes for probable cause on traffic stop and the search/seizure of car? Thanks
