Question is: I cant get Florida to release my License unless I am Licensed in there State with a interlock and Counseling. There law States that I have to have the Interlock but I do not live there anymore.I have read into the Law and see It's Interlock -or Counseling not both.So it's up to the descresition of the officer. Not what the Dept of Motor Vehicle's Statutes actually are.Washington will not except anything unless Florida releases my Florida License. The law at the time of my conviction stated interlock installed for 6 months. Now Florida wants Five year interlock and five years of counseling.Best to my Knowledge I only have the 6 moth requirement that I belive I can handle....Thanks Danny daniel_mckenzie33@yahoo.com
You are correct that Washington won't allow you to be licensed until Florida says that you are clear. For Florida...
My negligent 1st degree driving sentence allows for alcohol consumption but not driving with a BAC > 0.000. I naively thought I should use the device to see when it was safe to drive, causing BAC's x 3 > 0.000 without attempting to start the car (both the BACs and not starting the car recorded by the interlock provider). Will this count as a violation, even though I did not try to start the car?
Whether you committed a probation violation depends on the exact terms of your probation. Without seeing the court...
I was in Oregon at the time of the DUI and I have lived in Wa state the whole time and still do 17 years later. I took care of it: assessment, victims panel, treatment and gave the courts a certificate of completion. Fast forward 17 years later, I went to renew my license last week here in Washington state, like I have since then, and they told me that my license is suspended from Oregon! This was a surprise to me!!! Now the DMV in oregon is asking me to produce the certificate again (which I did not keep after all of these years) in order to get my license back! No records exist from that far back at the place I completed it at. So now, they say I have to do the treatment all over again! Even though I don't even drink. I was a kid back then!!! Do I need a lawyer?????
At a minimum, you should consult with an Oregon DUI defense attorney. They may know some secrets about how things were...
I have had no other incidences of non-law abiding behavior over the last 4 years and just got caught up with a case of "baby brain" while shopping. Yes. There was unpaid merchandise in a cart, with my purse, in the interior breezeway of Walmart. However, I was walking outside to try to get some air and WiFi to look up which decongestants are safe to take during pregnancy, sans cart. As I was putting my jacket on a loss prevention officer put his hand on my arm and asked me to follow him. His partner retrieved the cart. Regardless of my intent and the fact that I was not touching the cart to move it off property, it looked horrible. I must go to court and take responsibility for my actions at 36 weeks pregnant. How will my deferment be effected? What should I do to prevent jail time etc.?
Yes, it is entirely possible that your participation in a pretrial diversion program will be cancelled. How will your...
I received a DUI in Washington state last year and did not take care of it. I currently live in Oklahoma and would like to resolve this. I'm sure there is a bench warrant for my arrest in Washington.
You will have to return to Washington State to resolve the case. I strongly suggest you hire an experienced DUI...
It is my understanding that the arresting officer, who was also the one to administer the breathalyser, was supposed to observe me for a constant 15 minutes before the test. This officer might have observed me for 5 min maximum. He asked me a few questions while filling out paperwork, like address etc. He was constantly leaving the room, talking with another officer, left and then came back and uncuffed me and took me to the breathalyser room. On the results report it said he observed me from 22:35 - 22:56. I know for a fact this is not true. How can I obtain the video of this supposed observation, and if he is caught falsifying a report would that be grounds to get this charge removed?
You are going to need an experienced DUI attorney to help you with this. Discuss the case only with your attorney, and,...
I have been pulled over twice for driving under the influence in two different occasions. They are fairly far apart, about 7-8 years and about 1-2 years since the last one occured. First dui was dropped to negligence in the 1st or 2nd degree. Second dui was dropped to wreckless driving. My question is, if i were to apply at a car dealership and on the application it asks if i have been convicted of anything can I put down no? I understand that if it asks whether i have infractions or convictions invovling automobiles that i will have to write my negligence and wreckless down which I'm assuming will show on my background check and also, that they were both dropped from original dui charges. If there is an explanation area, should I even jot any of those down and explain? These were never too clear to me. I know that this last question is not your area of expertise. Mainly, it will be opinions but i know there is a chance that it could be a fact depending on if you are answering from experience. Whatever reason it may be please try to add a realistic input so that i may know my chances. Is there any chance that a big corporate dealership or a franchise car dealership of hiring me when i have two infractions invovling automobiles that were orginally suppose to be dui's? Ive always just assumed that those two dont mix but a friend thought i should seek professional advice because i could be mistaken since i never thoroughly checked. I know a lot about cars and is a well experienced salesman so selling cars, if possible could be very good for me. I also ask because i have recently helped my father puchase a car and it hit me that i've never really noticed a salesman drive the cars so it occured to me that there could be a possibility of me becoming one. Please, enlightened me. Thank you for your time and advice.
If the application asks if you've ever been convicted of a crime, then you have to say yes. Reckless Driving is a...
