Question is: I cant get Florida to release my License unless I am Licensed in there State with a interlock and Counseling. There law States that I have to have the Interlock but I do not live there anymore.I have read into the Law and see It's Interlock -or Counseling not both.So it's up to the descresition of the officer. Not what the Dept of Motor Vehicle's Statutes actually are.Washington will not except anything unless Florida releases my Florida License. The law at the time of my conviction stated interlock installed for 6 months. Now Florida wants Five year interlock and five years of counseling.Best to my Knowledge I only have the 6 moth requirement that I belive I can handle....Thanks Danny daniel_mckenzie33@yahoo.com
You are correct that Washington won't allow you to be licensed until Florida says that you are clear. For Florida...
My negligent 1st degree driving sentence allows for alcohol consumption but not driving with a BAC > 0.000. I naively thought I should use the device to see when it was safe to drive, causing BAC's x 3 > 0.000 without attempting to start the car (both the BACs and not starting the car recorded by the interlock provider). Will this count as a violation, even though I did not try to start the car?
Whether you committed a probation violation depends on the exact terms of your probation. Without seeing the court...
I was in Oregon at the time of the DUI and I have lived in Wa state the whole time and still do 17 years later. I took care of it: assessment, victims panel, treatment and gave the courts a certificate of completion. Fast forward 17 years later, I went to renew my license last week here in Washington state, like I have since then, and they told me that my license is suspended from Oregon! This was a surprise to me!!! Now the DMV in oregon is asking me to produce the certificate again (which I did not keep after all of these years) in order to get my license back! No records exist from that far back at the place I completed it at. So now, they say I have to do the treatment all over again! Even though I don't even drink. I was a kid back then!!! Do I need a lawyer?????
At a minimum, you should consult with an Oregon DUI defense attorney. They may know some secrets about how things were...
CAUSE 9 y 0 04 97 3 ( without spaces of course ) - Got a DUI in 2006 . Found guilty . Set for probation , treatment and self help . Wasn't able to complete . Judge then dropped all those with the condition oh today house arrest OR jail time . I chose house arrest . I've pulled my WATCH report . The DUI is gone , however the SOL states they need a corrected report to update me in their system ? How do I do that ? I don't remember the public defender that
My suggestion would be to contact the Clerk of the District or Municipal Court where you were convicted and either a)...
I got an DUI in 2006 . I was found guilty , given probation , ordered treatment and a few other things . However I never completed treatment . 3 months ago I went and spoke with the judge , he gave me the option of 90 days house arrest and he dropped the DUI , the probation and the treatment . Now my issue is , according to SOL they believe I'm still ordered to do these things for the courts . They aren't requiring me to do anything aside from an SR . Asked me to obtain proof of my requirements being dropped . Now normally I'd cal my lawyer . . . however my lawyer quit the week of and I had a public defended in which I had never met in there with me . I have no idea how to contact , who to contact or what I'm suppose to be doing .
It seems to me that you're a little confused about what happened in court. The judge would not have dismissed your DUI...
I was charged with a DUI 4 years ago in Washington state. I was granted a deferred prosecution. My license was suspended briefly by the DOL (DMV?). Anyway, 4 years later, there are a couple job opportunities I'm intersted in applying for. They want to check my driving record. So my question is kind of a 2 parter: a) Will the suspension/charge/deferral show up on the employers DRIVING RECORD request? and b) Can my DOL(or DMV) driving record be expunged/vacated/sealed similar ro a person's criminal record?
a) Yes. Any alcohol-related suspension will show up as will a deferred prosecution. b) No, you cannot expunge,...
My boyfriend had 2 dui's one was dropped, the other he was on probation for 5 years, required treatment and pay fines. This week he went to court and the judge dropped his probation completely 24 months early in exchange for 90 days house arrest and NO treatment or fines. Called dmv (dol? It's DMV where I'm from) and they said he can't get a DL until he's completed treatment and probation..but those are not required by the courts anymore. Now what? Had a public defender on the case but he's MIA unless in court. What do I do now? What proof do I need to hand over? We assumed since it's pretty much dropped (comes off his record 2014) he'd be able to just go take the test, pay a fee and be legal? No?
DOL is the governing body in WA over you license so what they say goes. The courts have no control over DOL. You...
