I was arrested for a DUI, got a lawyer, and plead not guilty, my lawyer is putting off the sentencing/conviction as long as possible so I can apply to the deferred act, so if I haven't yet been found guilty or sentenced of said DUI, will it still count against me while they are reviewing my case, or will it not matter since I haven't been yet found guilty? My lawyer can put the sentencing off until after my application has been approved or denied.

Last week I attended a public house when someone spiked my drink. I did not know at the time but they also rang and reported me to the police for DUI. I had my child with me as I was not staying long. I am 6 weeks away from finishing my final year at uni and am worried this will stop my career before it even begins. I blew 64 on the breathalyzer then 47 and 53 in the station. I requested my blood to be taken as I knew I had not drank enough to be over the limit. What would be the worst case scenario bearing in mind I have no proof of the person that spiked my drink except for the say so of friends. They had not realised it had been put in my drink - they thought it was the birthday girl who was not driving that night.
