Can charges be dropped/dismissed if a state trooper that wrote my Police Criminal Complaint in Pennsylvania put a fake birthday?
I am being charged with numerous things, DUI D1 & D2/marijuana/paraphernalia, headlights being off, & wreckless driving. The problem is the police officer arrested me, put me in his patrol unit, did not read me my rights and questioned me about where I get my drugs!? Also, after everything happened, about a month later, I got my summons for a preliminary and I read the police report. This state trooper is claiming my birthday as 12/23/1991, when its 03/18/1994!? There should be no reason for this. I gave him my correct birth information! What can I do? At this point I am looking for a lawyer to drop ALL charges or something. Excuse my language but this is BS. What can be done!? Thank you.
I would contact an experienced DUI attorney to go over all your options and possible defenses. It is not a guarantee...

You need to stop placing incriminating information on line. Retain a lawyer with expertise in this area and have them...
After a DUI and possible incarcenation, are there programs out there to help people get back on there feet again? Not having the ability to drive?
I would talk with your attorney who should be able to give some direction to you. Every case is different but...
My appeal date with PennDot for refusing to take a blood test (complied with breath test but was never told what they wanted me to sign which was the blood work form) is in about two weeks and I was wondering if I should file a petition for an OLL before ? If denied, can I apply again ? , or appeal ?
You are not eligiable for an OLL through PENNDOT for a refusal. I would contact a qualified attorney to go over your...
PennDot refusal after I complied with a breath test, was never read info for blood request and released.
Upon receiving a DUI, I was taken to the police DUI processing center by the two security guards whom made the initial arrest. When there, I complied with a breath test and was then handed a packet and told to sign. I asked what I was being asked to sign because I did not want to incriminate myself and if my lawyer could explain it to me. Immediately after I was released without ever being told I would be getting a refusal from PennDot until I received the notice in the mail. How likely are these appeals turned over ? If I or my future lawyer seeks to contact the officer would let/can they work something out for this ? Is there a higher appeal of they sustain ?
This is a matter you will need to hire an attorney to handle to make sure it is done correctly and to have the best...
IF that were to happen and I reside in one part of the state and conviction were to be in another part of the state. Would they allow me to drive my vehicle home and then begin the suspension along with community service?
The suspension starts only when PennDOT receives your license and ends only when you receive the license back. As a...
From your personal experience, how many solely alcohol-related DUI ARD programs have included random drug testing?
Person X has no prior record, is a good university student with professional aspirations, and presented him/herself this way during court proceedings and initial meeting with probation officer. X was pulled over for a moving violation and refused the chemical test. A breathalyzer was administered upon arrest, and X has been in the ARD program for three of six total months so far without having to take any drug tests. X is complying with all court mandated requirements, has completed the Alcohol Highway Safety Class, and has been up to date with reporting forms. To X's knowledge, his/her probation officer does not even remember him/her. X simply wants some clarification (actual numbers) regarding the likelihood of a random drug test with X's current situation. PA SPECIFIC APPRECIATED.
Person X is an interesting yet contradictory individual. On the one hand X is a "good university student with...
