I am being charged with numerous things, DUI D1 & D2/marijuana/paraphernalia, headlights being off, & wreckless driving. The problem is the police officer arrested me, put me in his patrol unit, did not read me my rights and questioned me about where I get my drugs!? Also, after everything happened, about a month later, I got my summons for a preliminary and I read the police report. This state trooper is claiming my birthday as 12/23/1991, when its 03/18/1994!? There should be no reason for this. I gave him my correct birth information! What can I do? At this point I am looking for a lawyer to drop ALL charges or something. Excuse my language but this is BS. What can be done!? Thank you.
I would contact an experienced DUI attorney to go over all your options and possible defenses. It is not a guarantee...
i was only four blocks away from my home, the police officer ONLY PULLED ME OVER BECAUSE HE KNEW WHO I WAS. we all had our seatbelts on. my wife suffers from seizures. this cop knew that. he had my wifes car towed a year ago for a bad inspection, made her and my son get out the car in the middle of the street and TOOK the car! she took it to court and won!! I HAVE NEVER BEEN IN TROUBLE W DRIVING, MY LICENCE BEEN SUSPENDED FOR 9 YEARS FOR 1 DUI.. i explained to the cop my wife felt realy ill.. he knew our situation and we were 4 blocks from our home. he has personal issues w me and my family... this has been going on for some time. i come from a small town and this cop just DONT STOP W THE HARASSEMENT.... he had no reason to pull me over. he past us and made a uturn 3 blocks away.
You need to stop placing incriminating information on line. Retain a lawyer with expertise in this area and have them...
After a DUI and possible incarcenation, are there programs out there to help people get back on there feet again? Not having the ability to drive?
I would talk with your attorney who should be able to give some direction to you. Every case is different but...
IF that were to happen and I reside in one part of the state and conviction were to be in another part of the state. Would they allow me to drive my vehicle home and then begin the suspension along with community service?
The suspension starts only when PennDOT receives your license and ends only when you receive the license back. As a...
Person X has no prior record, is a good university student with professional aspirations, and presented him/herself this way during court proceedings and initial meeting with probation officer. X was pulled over for a moving violation and refused the chemical test. A breathalyzer was administered upon arrest, and X has been in the ARD program for three of six total months so far without having to take any drug tests. X is complying with all court mandated requirements, has completed the Alcohol Highway Safety Class, and has been up to date with reporting forms. To X's knowledge, his/her probation officer does not even remember him/her. X simply wants some clarification (actual numbers) regarding the likelihood of a random drug test with X's current situation. PA SPECIFIC APPRECIATED.
Person X is an interesting yet contradictory individual. On the one hand X is a "good university student with...
Officer gave me breath test but never explained what they wanted me to sign or why (turned out to be blood test request). PennDot wants to suspend my license for one year and I currently go to school full time and work full time with commuting 45min+ to each location. Would I qualify for one of those licenses after the mandatory 60 days or can I appeal the denial to the next level? I'm also curious if I should even use my lawyer for this matter since he has not been very helpful thus far. Officer agreed to let me into the ARD program as well.
If you are charged with a refusal and PENNDOT suspends your license for 1 year unfortunately you are not eligible for...
I was charged with a DUI and at the prelim hearing the officer said he would not contest me applying. The prelim was continued until next month so that I can finish school. When can I apply for ARD ? Does my lawyer have to do it or can I go down to the courthouse and file it myself ?
Self-representation is never a good idea, even for ARD. Each county has its own requirements that have to be completed...
