My neighbor has had multiple DUI's and I know him to be on alcohol restriction for the probation he is on right now. I have seen him drinking on the side of his house and am not sure if his wife knows. They have kids and he is a real loser in my opinion. I worry about him driving drunk in our neighborhood since there are so many kids around. What would his consequences be if I called in an anonymous tip on him drinking and his probation office found alcohol in his system?
There are two kinds of alcohol restrictions. One is where the MVA places a restriction on the license. He would not...
I lived in washington state and in 2007 i recieved a DUI. After that i had to go back to the east coast. Since then i have tried to work with kitsap county and they always say they will work with me. However they never send me the information or return my phone calls. I believe they wish for me to come out there so they can throw me in jail. With there reluctense i have had many issues providing for my family and many issues with getting to and from work.
You need to repost your question and list the location as the State of Washington. You also can use the "Find a Lawyer"...
I have been offered a very good job, im concerned about the background check. My misdemeanors happened 17 years ago. The DUI(PBJ) happened 18 months ago
The expungement procedure in Maryland is very specific. Unfortunately, DUI PBJs cannot be expunged. The record stays...
I am being charged with a DUI for the second time. My first DUI charge occurred almost 5 years ago (in 2 months). Will I be charged as a a first time offender since I was never actually convicted of a DUI? I have heard that I would, but have also been told the judge might make an example of me because I got a second chance the first time and have messed up again. Both DUI's I had a BAC of 0.09. I was on supervised probation from November 2008 through May 2010. There was a small confusion during that with whether or not I was required to go to alcohol classes, and I did end up going after it being clarified in October 2009. I am a single mom and really can't afford to lose my license, have an interlock or extensive alcohol counseling fees.
You are not eligible for another PBJ since it is your second offense within 10 years. Under the law, you are not...
Alright, so I'm a full time student finishing off my AA degree this semester at a community college with a 3.47 GPA. Unfortunately over the summer I decided to ride an electric scooter to a 711 when I was under the influence of alcohol. I was arrested for DUI and blew a .14. In August 2013. I went to court and the judge ordered me 1 year of Maryland probation before judgment/alcohol treatment class/impact panel meeting. I have completed the alcohol treatment class and the impact panel meeting but I really want to transfer to an out of state 4 year university in Pennsylvania in late January 2014 spring semester. I have a great attorney and we have filed the motion but I wont know if I can go or not until December. Can someone please honestly tell me my chances of being able to go?
Your lawyer is the only person who you should be consulting. We are not odds makers. Even if the probation is not...
Entered program 10/2013. 1 fail per month @ .027 happened 2 months. 1st month had few failures. Blame Immodium AD or toothpaste. Was Not Drinking; AM failures. After adjusting brush time wait, I wound up blowing literally 10> min after brushing ( immed sched change - wasnt thinking)on this cycle, will be 1 fail for the cycle and will be my fourth. Unknown to me, I could have disputed these failures all along and didn't try because wasn't aware I could. Orig susp. was 90 days. AA/Alcohol classes attending. Havnt had drink in 19 days. I'm screwed, right? Thank You
No reason you can't go to an MVA hearing and make this argument. Make sure your address is up to date with MVA and...
My ex has an upcoming Jury Trial for her second DUI in 5 years. According to what I have read, Maryland has a minimum 5 day sentence for this, if convicted and maximum sentence of 2 years. I have concerns on her parents fleeing with our daughter if she is convicted. There is a history of her mother hiding our daughter from me at my ex wife's request. I don't want to cause problems where there aren't any, but want to protect my daughter from the trauma of having no access to either of her parents if her mom ends up in jail.
Typically, grandparents do not have greater custodial rights than parents. Based on your concerns, you should look...
