I told my lawyer that I wanted to see the tape from the officers car . What he put in the report was untrue and I wanted his camera to prove his story. The DA and Officer could not provide it and the judge dismissed the charge that day. I have one more appearance for the DUI charge can I be convicted of that charge with no Blood Alcohol test or evidence . My Lawyer says they still can . How can that be with no evidence . The car was parked and the person I was driving home was intoxicated. I stopped at a convenience store he went in to get cigarettes and a cop was in the store and followed him to my car . I told him I was giving him a ride home and not drinking . His report said he then let me go and then I hit a curb . He never even let me back in my car after he got me out .

I have a NJ license, got a DUI (and subsequently refused a breathalyzer) in PA, and pleaded into their "ARD" program (i.e. no DUI conviction). Now PA wants to suspend my license (a separate civil case/administrative matter) for one year because I refused. I am moving to TN in one month and am wondering if it is smarter to get my TN license before my driving privileges are suspended in PA, or just keep my NJ license and hope for the best!

The accident I had was before I had ever been convicted of DUI 2nd in a different state . I paid the ticket of following to close as well had the other parties car repaired and thought all is well . Over a year later issue a warrant for DUI 3rd . I have long ago completed all of the court orders , paid fines , treatment and DUI classes and have my license back , as well have not taken a drink in 2 years and have my life with family better than ever . I am going to be in court in 4 days and could use some advice on what to do and expect .
