I had been drinking at my house with my girlfriend who was over. She decided to leave around midnight while it was raining. I did not want her to walk alone through the streets while it was dark and raining so I jumped in the car to go pick her up. I pulled into a parking lot near where she was walking and jumped out of the car to go talk to her. I left the car running and while we were standing talking a cop pulled up. He asked what we were doing and I said I was picking up my girlfriend to bring her home. When asked if i had been drinking I said I had a few. Was given a field sobriety test and declined breathalyzer until getting to the station where I blew a .16. I have no other offenses except for a speeding ticket two and a half years ago and one this year. What should I be expecting
My thought is that you need a lawyer and you need to be careful what you say in a public forum such as this.
Pulled over for missing a headlight & arrested for possession of marijuana in NH... what sort of punishment am I looking at?
When the trooper smelled smoke & asked if I'd been smoking, I admitted I had. Trooper asked if it was still in the car. I said it was. He asked me to hand it over & I did (about a gram or 2 max), along with my pipe, with some weed left in the bowl. The trooper allowed me to drive myself to the local police station and arrested me, forgoing bail. I've been given a summons to appear in court to enter my plea. Is there any reason to plead not guilty, since I voluntarily handed over my stuff? What sort of fine am I looking at, with no prior record (only 2 traffic tickets in 25 years)?
I think you should let the case work itself out. As an attorney, my ears quickly perked up when the Trooper alleged to...
an undercover officer arrested my son while he was walking to a an outdoor concert - the beer can wasn't opened and they handcuffed him and he had to be bailed out, but he wasn't intoxicated and he didn't have to blow...but they never read him his rights. Shouldn't they have read his rights when he was arrested? and what could happen to him? His first offense never been arrested before and it was off campus and he lives out of state. He was also very respectful with the arresting officer.
The police are not required to provide Miranda warnings unless they intend to question your son after he is under...
It was my first time ever getting pulled over for anything. I was completely cooperative, poor judgment. I consented to a breathalyzer test, blew a .23. The police officer told me that because I was so cooperative, he was going to recommend the charges be dropped to his Chief. He told me to call the chief first thing Monday morning.
It is possible, but with that high of a breath test, it is not probable.
I received my second DUI in 6 yrs in NH, my first in NY. Will I face jail time?
You will only face jail time if you are convicted of a DWI subsequent or aggravated charge. You should consult with a...
my son blew a 0 on the breathalyzer but the police still wanted him to take a blood test, he has no insurance so he asked the police if he could just take a urine test instead, the police said no and told him if he refused to take the blood test he would be arrested for refusing to take the test, he did not refuse, he just asked to take a urine test instead..before I knew anything about this he went to court and pleaded guility, can he still appeal this seeing he blew a 0 ? it happened a couple of weeks ago.
There are a number of factors at play when you consider an appeal after a guilty plea, and all of them depend on more...
I was arrested for my first DWI, took the field sobriety tests and blew a .11, I was told I could refuse the test but was never told the consequence if I refused. I was taken to the police station but was never handcuffed, never put in a cell, they never searched my person and they let me keep my personal items the entire time(in the back of the cruiser and at the station). I was asked the basic questions; name, address, social, where I worked, etc. I was finger printed, had my picture taken, etc. however I was never read my rights or told that I was "under arrest". I paid the bail commissioner, was released that night and was given a court date. How should I plead in court? I can't afford a lawyer, do I need one if I try to fight it?
I would advise getting a lawyer. The consequences of having a DWI on your record are harsh and long lasting. Just...
