I had been drinking at my house with my girlfriend who was over. She decided to leave around midnight while it was raining. I did not want her to walk alone through the streets while it was dark and raining so I jumped in the car to go pick her up. I pulled into a parking lot near where she was walking and jumped out of the car to go talk to her. I left the car running and while we were standing talking a cop pulled up. He asked what we were doing and I said I was picking up my girlfriend to bring her home. When asked if i had been drinking I said I had a few. Was given a field sobriety test and declined breathalyzer until getting to the station where I blew a .16. I have no other offenses except for a speeding ticket two and a half years ago and one this year. What should I be expecting
My thought is that you need a lawyer and you need to be careful what you say in a public forum such as this.
When the trooper smelled smoke & asked if I'd been smoking, I admitted I had. Trooper asked if it was still in the car. I said it was. He asked me to hand it over & I did (about a gram or 2 max), along with my pipe, with some weed left in the bowl. The trooper allowed me to drive myself to the local police station and arrested me, forgoing bail. I've been given a summons to appear in court to enter my plea. Is there any reason to plead not guilty, since I voluntarily handed over my stuff? What sort of fine am I looking at, with no prior record (only 2 traffic tickets in 25 years)?
I think you should let the case work itself out. As an attorney, my ears quickly perked up when the Trooper alleged to...
an undercover officer arrested my son while he was walking to a an outdoor concert - the beer can wasn't opened and they handcuffed him and he had to be bailed out, but he wasn't intoxicated and he didn't have to blow...but they never read him his rights. Shouldn't they have read his rights when he was arrested? and what could happen to him? His first offense never been arrested before and it was off campus and he lives out of state. He was also very respectful with the arresting officer.
The police are not required to provide Miranda warnings unless they intend to question your son after he is under...
It was my first time ever getting pulled over for anything. I was completely cooperative, poor judgment. I consented to a breathalyzer test, blew a .23. The police officer told me that because I was so cooperative, he was going to recommend the charges be dropped to his Chief. He told me to call the chief first thing Monday morning.
It is possible, but with that high of a breath test, it is not probable.
I received my second DUI in 6 yrs in NH, my first in NY. Will I face jail time?
You will only face jail time if you are convicted of a DWI subsequent or aggravated charge. You should consult with a...
They sent me paperwork that says that I have to appear in ANY New Hampshire court on April 4th to answer the charge. Does that mean I just walk in to a courthouse and announce that I'm there or do I call first and what is this court date for. I got another letter stating that I lost my license for 6 months and have to turn it in by April 6th. What am I supposed to do next.
You need to call a lawyer ASAP as your court date is in three days I'm available at 603-893-8008.
I was charged with a DUI almost a month ago and since then have moved, I won't be able to get back to the previous state that I lived in to make the court hearing, will a warrant be put out for me, what is the best thing for me to do? I won't be driving anymore so I do not risk being pulled over but what can be done in terms of me not making the court date?
Almost every district court in the nation will require you to appear on this type of charge. So a warrant will issue....
