I have a brother with a long file of dui's, he has crashed into other people, and numerous other charges. Why isnt he in jail?
My brother is an alcoholic. He usually goes to jail once a week or at least a few times a month. He is agressive toward family and is very violent at times. He has driven into other drivers while drunk, he has assaulted police officers, he has so many other charges. The most recent is assaulting me and throwing his daughter down the stairs. When he went to court for the 2 counts of child abuse, all he got was probation for a year. We live on a reservation. The Wind River Indian Reservation. Why does he keep getting out of trouble with the law? Why isn't he in jail for longer than a couple weeks?

Yes, it will look better because its not a criminal conviction, which a DUI is under most state laws.

I was pulled over for speeding and the officers said they could smell alcohol. I did imbibe in alcohol many hours prior to driving and knew I was fine by then. They asked me if I would submit to a "field sobriety test". I said I would. I was wearing very high heeled shoes at the time and figured that they might inhibit my ability to walk a straight line, so I took them off. Being barefoot on blacktop proved to be even worse, as I stumbled off the line a couple times because the blacktop was hurting my feet .They said I failed. They arrested me for a DWUI. When I arrived at the jail, I submitted to a breathalyzer. It was well under the legal limit. I spent the night in jail and was bailed out the next morning.

I was in a car with a drunk driver while I was also intoxicated. The driver and I were both issued MIP's, but the police also found cannabis in the vehicle. It didn't belong to me, it was the drivers. The driver fully admitted that. Should I argue against the possession ticket? I never had anything on me, nor did I own any of the things found. I was stopped for apparently running a stop sign that I still can't find. No lights on the patrol car were on to pull me over. I parked my truck and was walking in to my motel room when I was asked to come to the officer parked behind me. He was very obviously being trained and I was the guinea pig which he later admitted. The entire stop was unprofessional. My "heel to toe" test was done on a slope of a hill which when the officer demonstrated he stumbled as well in front of his camera. Had me blow in the breathalyzer 4 times, which I had chewing tobacco in for all of them. He never asked me to clear my mouth or if I had anything in it. I made sure when he said they were taking me to jail and asked to spit my chew out in front of his car. Did not read me my rights. Then searched my truck.
