Should I plead no contest for my first dui offense?
I was driving home and totalled my car Thankfully no one else was involved.
You should plead no contest if you want to lose your license, be convicted and have this on your record. Otherwise, you...
I refused the breath test but was found not guilty after almost a yr going to court. Do i still pay a 500.00 reinstatement fee??
On Feb 28th 2012 i was backing out of a drive way and tapped a car behind me. A man came out of no where and jumped on the hood of my car (In his under ware) so i hit the car again by mistake cause he scared me. The police showed up, did not give me a sobrity test, just cuffed me and threw me in the police car and took me to jail. I refused the breath test because i had, had 1 and a half rum and cokes and didn't know how much that would show on the test.
In most jurisdictions, the administrative consequences on your driver's license are independent of the results in the...
What you think of my case?
No breath test no one else injured no field sobriety tests, police think i was drunk but I wasn't at all I was in shock from the accident.
This is a very detailed, and therefore very recognizable, description of an event. I believe you should refrain from...
I filed a surcharge appeal from an auto accident and am awaiting a hearing.
In April 2012 I was involved In a small fender bender. An SUV swerved into my lane, without signaling, trying to get around a stopped vehicle turning left. Because of this I struck the rear of his vehicle at a low rate of speed. There was NO damage to the other SUV and minimal damage to my sedan (grille damage estimated at $275) we decided not to pursue. 6 months later I receive notice the other driver is going after my insurance company. I am found at fault and the other driver is paid out $21,000 for a whiplash claim (14 k medical 7 k payout) he did not claim any property damage. I have picture of both vehicles on the day of the accident. And need to gather more evidence to help my appeal. Any suggestions?
What is your basis for an appeal? Your insurance company does not have any motivation to pay more on a claim then they...
If I wasn't seen driving and my breathalyzer is out of the case do I have a chance to fight?
I'm accused of dui(3rd) last one was 10 years before, I was seen arguing with a guy that says I hit his car when the police arrived and arrested me for dui. If the breathalyzer is not allowed and police never witnessed me driving do I have a fighting chance in winning???
Would have to know more facts about the case. You should speak to an attorney about your case. Best of luck!
How to seal record in Massachusetts after acquittal ?
I was charged with OUI in Massachusetts 2 years ago, however The case finally went to trial and I was found "Not guilty." I will be entering the workforce shortly in the financial services industry, and usually a spotless record is required. I would like to seal my record to minimize the impact of that arraignment however I am unsure on how to proceed. I would also like to know how sealing the record may affect information that private background checking companies may report to my potential future employers.
Good for you, that is a smart thing to do and doing so before sending out job applications is a very good idea. You...
