i live in indiana and i recently got arrested for a dui and they also charged me with neglect of a dependant because my son was in the car. i wasnt actually driving the car it was parked with two flat tires because my sons uncle cut them. i passed all the field sobriety tests but i blew a .10 on the Breathalyzer and the legal limit is .08 now cps is involved. i havnt met with them yet but im afraid that when i do their gunna take my son. i dont know how to fix this huge disaster. plz help me

At the top of the Affidavit of Probable Cause it says who the arresting officer is, gives a description of my vehicle, describes my race, etc. Then says that the accused was observed at Dunes State Park operating a vehicle. Yet none of the Preliminary Observations boxes are checked and no reason for stop was explained. Under Accident Information it list 1 vehicle was involved. Minor damage was reported to my own vehicle. Truck was stuck in the sand, w/ the back end off the pavement. In the police report it says that the officer was approached by male subject (me). Being that the officer was approached should indicate that I was outside the vehicle, keys in pocket. Truck was stuck in the sand, off the edge of parking lot. Does saying I am the driver admit guilt? Does officer have true PC?

My dad got arrested for public intoxication and then immigration came and took him. He has a long list of DUIs and traffic violations, but they are from over 10 years ago. He also has 2 domestic violence arrests and drug paraphenelia arrests from 17 years ago. Will ICE take into consideration that these events happened a long time ago? Does it also matter if he was not convicted or guilty? He is in immigration detention with no bond and has a hearing in Chicago in a month. Is this his final hearing before he has to go out of the country? He's already had one court where they read him his charges. What can I do for him? When he was pulled over the officer never said why he was pulling him over. Asked if he had been drinking, my son said a few, he then made him do several sobriety test and breath test. Officer said he blew a .12 handcuffed him and took him to jail. We bailed him out ($755.00). My son asked when he got to the jail why he was pulled over he was told he had a brake light out. The officer never said a word about a brake light. His court date is set in one week, the ticket just says OWI endangerment. Is this a Class A or Class C misdemeanor? Should I seek an attorney. Something does not seem right about this stop.
