US Constitutional stance vs. KY KRS on right to own and insure a vehicle after being charged with a DUI. Is the right to have the ability to carry children to doctors, school, grocery, etc. taken away even if the convicted DUI loses license but still has licensed legal driver. Boy was told he could have NO cars in his name nor get insurance on the vehicle although another driver is listed as the primary driver. Is the right to own a vehicle a constitutional right regardless of having no license, don't drive the car, hire legal drivers.
You have no constitutional right to own a vehicle per se. A judge can order a defendant convicted of a DUI not to drive...
I received around $2500 in court fees and fines, and a jail sentence of 21 days in August of last year. My fees/fines are due 2/11/2013. Since my release from jail I've lost my job, and have been looking ever since. I recently moved in with some friends close to town to increase the likely hood of finding a job, although it is still very hard due to my lack of a drivers license. I've had a couple of interviews, but I've failed the background check every time. I'm expecting a little over $1000 in tax refunds and plan to use all of it to make a payment on my fines. Considering this, what can I expect when I go to court on the 11th of next month? Is there any way I can avoid jail time?
In my experience, courts appreciate being told of difficulties early. First opportunity, schedule an appearance before...
The story - Had 3 beers and shared a little margarita over the course of two plus hours.Took my friend home and as i pulled into the driveway I was bluelighted. Told I failed to come to a complete stop at the sop sign (which as memory serves I very much did) and failure to use turn signal (which I didnt (it was residential)). Told me my eyes looked glossy, asked me to step out...and lets do a field sobriety test. I (regrettably) told him I believed the test to be waste due to his biased opinion but complied. Afterwards backup officer is holding the blow test and I say "id rather just take a blood test". Instantly cuffed. Coulnt afford to pay for blood test so I submit to the blow test at the station and blow .063, finest 12 hours in my life followed. I have no record, and no money. Advice?
You are likely eligible for a public defender. However, you would be better off with private counsel. Regardless,...
I had visited with an acquaintance at my home during which time I only knowingly had about 9 oz. red wine. Later that day I was in an automobile accident in which my son was in the car. They have charged me with the above charges. However I have no clear memory of having done any of this.. My friends have asked was it possible that something had been slipped into my beverage. I am at a loss as to what possibly happened. I know I have been trying to clean up my act and stay out of trouble. I am on SSI and worry that a public defender will not be able to handle my case correctly/thoroughly. I am needing advice.
These are serious charges with potentially serious consequences. I highly suggest that you consult with a locally...
drug test says I had 500 ng/l oxycodone (prescribed 6 30 mg per day) and 40 ng/ml Xanax (prescribed 1mg x2 a day) and it also said I had amphetamine which I suppose is like adhd medicine but I do not take that so I don't know why it showed up. the amphetamine did not register how many ng/ml there was. would it be possible to get it amended to a lesser charge?
You should hire an experienced DUI lawyer to represent you in this case. Unless you have a prescription for...
