So sunday before memorial day my friend kicked me out of his house after a night of drinking. I admit I was still pretty drunk but my now ex friend refused to let me sleep it off. After getting off a ramp I must have been going too fast because I spun, hit a guard rail and wrecked my car. No other people were hit or in the car with me. When cops arrived they said I smelled like alcohol still and took me to the hospital for a blood test. They did not check me for any injuries even though my car had been totaled. I have had no prior DUI's. I do have a record most recent was a disorderly conduct charge. Everything else is from years ago. I want to know how likely it will be for me to go to jail. Any advice in general would be good. Since I know I wont see my PD until my court date.

Is it possible to have a sentence reconsideration for a 3rd offense DUI sentence/ probation violation?
My Fiance was sentenced to a 12-24 month state sentence for a 3rd DUI. He was also sentenced to a consecutive 90 days for a driving under suspended license charge. When sentenced, his Probation Officer decided to charge him with his back time of 22 months running concurrent with the new DUI/Suspended License charge. We were told by his lawyer that he would be eligible to see the parole upon completion of the mandatory DUI sentence (after 15 months) but it turns out he will not see the parole board until the whole 22 months is served. He has been in for about 7 months now. Is there any action that we can take to ensure that he will see the parole board upon completion of the mandatory 15 months? Is a sentence reconsideration still at all possible or is it too late? Thanks for your Help!

Public Drunkenness (PA). Does walking on the side of the road at night count as being a danger to myself?
It was 2am. I'm 22 years old. Myself and two friends were walking back to my house in a suburban residential area otherwise known as my neighborhood. Google Maps estimates it as a 13 minute, .6 mile walk. The roads are not busy. The cops were the only cars we saw. We were not even talking. Cops pull up. Shine a light on us. Give some irrelevant reason for stopping us ("Kids bending signs"). They ask if we've been drinking. We say yes. I blew a .089. We get a citation. Is the threat of being hit by a car while walking on the side of the road enough to constitute me being a danger to myself? That threat is always there. It had nothing to do with the fact that I had been drinking. I wasn't drunkenly wandering around, I was taking the same 10 minute walk I always do in a familiar area.

I was charged with a DUI in Pa after speaking to a few lawyers they all say I qualify for the ARD program Pennsylvania offers. My concern is I am on my parent's auto policy in NJ, my car is registered in NJ as well my license is held there. I understand I technically do not get convicted if I get approved for the ARD and follow the steps from there. My question is will my parent's policy get affected? I was recently convicted of a DUI on 1/26/10 and I have a prior DUI from 1997. I was charged with a 1st offense and was given a one year suspension. I was planning on applying for an OLL because my lawyer said I was eligible after serving 60 days but Penndot says differently. Penndot states that they do not look back only 10 years to determine a 1st offense, they look back forever. So, in Penndot's eyes it is my second offense and I am not eligible for an OLL. The screwy thing is that Penndot does use the 10 year lookback to determine interlock requirements. Is it worth it to apply for the OLL, get rejected and try to appeal?
