I have not tried anything yet. What happened is that I was out and pulled over to stay at a hotel, my keys were out of the ignition and I had noticed a police car behind me so stayed in the vehicle. I informed him I had been drinking and refused to take the breathalizer. He then arrested me and took me to the hospital where once out of the vehicle took me inside and threw me face down on the ground inside and stayed on top of me until they drew blood from my system. I posted bail and am awaiting to speak to an attorney before my court date on 11-5-2008. I still have my license. My Ex received yet another DUI back in February of this year. This is his 3rd one but the previous two were over 10 years ago. This one is an excessive while caring a concealed weapon while under the influence. So far his pre trial dates have been reset three times. He now has a pretrial hearing setup for 6/17/2013 and was severed with a notice of hearing today. I would like to know what the expected outcome would most likely be in his situation. I know that they can't charge him for a 3rd DUI, but I'm assuming the previous two plus the other things on his record would play against him. I would like for him to be a better father to our daughter but he has a drug and alcohol problem. I am hoping that they lock him up for a while so that he can get sober and get the help that he needs.
