I was charged with DUI/DUI per se for drinking a beer inside of my parked car. We had our doors open for airflow with our legs sticking out and my keys were in my pocket. The officer, who rode up to the side of my car on a bicycle, wrote in his police report that I had the keys in the ignition. He flat out LIED! This officer was a complete jerk from the beginning of the ordeal. They cuffed me, didn't read Miranda rights to me, and took back to the police station where I blew a 0.105 BAC. My friend (and witness) who was in the car with me when this happened wrote a statement re-emphasizing that the keys were NOT in the ignition. How can they convict me of a DUI if it's mine and my friend's word against a cop's word?

It's only been roughly two weeks but I'm feeling increasingly nervous because I am told I have to request a DMV hearing using the notice within a week or face not having a chance to try and get it back. I am also concerned about what may happen if it gets lost in the mail or sent to the wrong address because I moved recently and gave them a different address from my license.
First and foremost, seek the advice and consultation of an experienced DUI attorney, not a friend. You need to make...

Despite the downward trend in incidents of drunk driving in recent years, statistics show that there is a DUI-related fatality every 45-60 minutes in the US. This may be why most states have cracked down on drunk driving by increasing statutory penalties, especially for repeat of...
If you are convicted of driving under the influence (DUI) by a trial court, you still have a right to appeal the court's finding to an appeal (sometimes called appellate) court. This appeal is not automatic. Appellate courts are very strict about when appeals are filed. There is ...
A DUI conviction typically includes probation, which is designed to deter repeat behavior and ensure that you stay out of other legal trouble. If you are arrested for a serious crime while on probation, you can have your probation revoked. Your DUI probation conditions will depend on where you live,
