Finding no alcohol or drugs, I was arrested for DUI drugs. The reason I did poor is due to my previously broken femur bone. My miranda rights were not read and no one informed me that by refusing to give urine aren't blood, that I would lose my liscense for a year. I aslo was not informed that I have 10 days to get a permit to drive to and from work and appointments. I was incarcerated for 11 days and missed that grace period. My wife has a brain tumor n seizures, plus I have a 4 yr old that we can't get to pre school. So far, I have not been indited yet and nobody seems to be able to help me with my liscense or tell me what is going on. What are my options? I lost my job and my wife can't drive due to her seizure disorder.
If you were incarcerated for 11 days, that should justify the delay in sending the ALS hearing request. Get an attorney...
I was convicted of a dui in TN in 1999 with a 0.3 BAC, I was arrested in a dry county. I paid all my fines and completed my community service within the time specified. I was and still am in the US Army. After I completed my requirements i was deployed to Korea for the next year. 2 Months ago I got a letter stating that I would have a warrant for my arrest if I did not contact the sheriffs office. Upon doing so they told me that i did not contact my probation officer like I was told to and they have not been able to contact me until now (even though I am still in the Army). They want me to complete another 40 hours of community service and pay a court fee. Because this was 14 years ago I no longer have the records to prove myself. Can they do this or should I try to fight it?
I advise that you direct this to TN criminal defense attorneys. Notwithstanding, based on your facts, you may be able...
When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.
It appears you are working with the DDS provided form. You are not required to give the facts requested. My advise is...
my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?
The legislature decided many years back to enforce a harsher license suspension for people who refuse to submit to a...
I have a DUI in another state in 2005. I am facing a current DUI in GA and they are trying to make it 2 in 10yrs instead of 1st in 10yrs. Doesn't Georgia law count second in 10 years for anything after 2008 or is it prior arrests also?
It will be your 2nd in 10 years if you plea or get convicted. No getting around this. You most likely need to speak...
I received a Second DUI in GA because it was in a 10 year period. I want to seal the 1st DUI in NV because they allow that within a 5yr period. to make sure that doesn’t affect the outcome of the most recent received in the state of GA.
My guess is that you will not be able to seal the DUI in NY, now that you have a pending charge elsewhere. I'd suggest...
Isn't it true that if I hire a lawyer ,the lawyer will negotiate and get me into the DUI program and doing community service. But I can do this myself. I don't need a lawyer to get into a DUI program especially for my first time DUI. IF I hire a lawyer I just end up paying a big lawyer's fee.
There is no "DUI program" on a first DUI in Gwinnett, or any other Georgia County for that matter. If you want really...
