What is the statute of limitations for a dui that happened in 1999?
I was convicted of a dui in TN in 1999 with a 0.3 BAC, I was arrested in a dry county. I paid all my fines and completed my community service within the time specified. I was and still am in the US Army. After I completed my requirements i was deployed to Korea for the next year. 2 Months ago I got a letter stating that I would have a warrant for my arrest if I did not contact the sheriffs office. Upon doing so they told me that i did not contact my probation officer like I was told to and they have not been able to contact me until now (even though I am still in the Army). They want me to complete another 40 hours of community service and pay a court fee. Because this was 14 years ago I no longer have the records to prove myself. Can they do this or should I try to fight it?
I advise that you direct this to TN criminal defense attorneys. Notwithstanding, based on your facts, you may be able...
I was told by an attourney not to take a subriority test. After taking and not failing , but doing poorly on the roadside test,
Finding no alcohol or drugs, I was arrested for DUI drugs. The reason I did poor is due to my previously broken femur bone. My miranda rights were not read and no one informed me that by refusing to give urine aren't blood, that I would lose my liscense for a year. I aslo was not informed that I have 10 days to get a permit to drive to and from work and appointments. I was incarcerated for 11 days and missed that grace period. My wife has a brain tumor n seizures, plus I have a 4 yr old that we can't get to pre school. So far, I have not been indited yet and nobody seems to be able to help me with my liscense or tell me what is going on. What are my options? I lost my job and my wife can't drive due to her seizure disorder.
If you were incarcerated for 11 days, that should justify the delay in sending the ALS hearing request. Get an attorney...
What information is required in a hearing request for my driver's license?
When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.
It appears you are working with the DDS provided form. You are not required to give the facts requested. My advise is...
Why are the officers and the system in general harder on individuals who refuse Dui tests
my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?
The legislature decided many years back to enforce a harsher license suspension for people who refuse to submit to a...
DUI in Duluth Municipal Court.
I was arrested for a DUI. The case is in Duluth municipal court. I worked out a deal with the solicitor. I finished all classes and all requirements. Finished my probation a month ago but still haven't heard from them regarding official disposition. Do I need to request that or is it mailed to me? And if i need to request it do i just show up in court and what is the the process? Thank you.
It's not clear if you were convicted, or if you participated in some type of pre-trial diversion program. If you were...
DUI less safe drugs and roadblocks
I was stopped at a roadblock shortly after smoking marijuana. I did have it in my possession and my blood was tested. I had also taken an unprescribed adderall previously that day. In my understanding, they must prove that I was a "less safe" driver because of the marijuana. How can this be done if I was stopped at a roadblock? Also, how will the adderall come into play (if at all)?
Most prosecutors will take the "any in your system" approach. But you are correct about less safe, it is difficult if...
Clearing a DUI warrant for a non domicile
Dear sirs I am an English national who was working in Georgia on an H1 B visa from 2001 to 2002. I was arrested for a DUI in 2001 and paid my fine and attended court. I thought that the matter was closed however I have taken a vacation in the USA twice in the last few years and every time I get stopped for an outstanding warrant. Is there any way I can get this charge removed? If it's not possible to have the charge removed would there be a chance of being denied entry to the USA by border control? As mentioned I get pulled and questioned by border guards but have been allowed entry but I would like to get this warrant closed out or removed if possible. I'm planning a honeymoon in Seattle this fall and would like to have this cleared before then if possible.
Usually a misdemeanor will not affect you because most states do not extradite misdemeanants. However, why would you...
