I was told by an attourney not to take a subriority test. After taking and not failing , but doing poorly on the roadside test,
Finding no alcohol or drugs, I was arrested for DUI drugs. The reason I did poor is due to my previously broken femur bone. My miranda rights were not read and no one informed me that by refusing to give urine aren't blood, that I would lose my liscense for a year. I aslo was not informed that I have 10 days to get a permit to drive to and from work and appointments. I was incarcerated for 11 days and missed that grace period. My wife has a brain tumor n seizures, plus I have a 4 yr old that we can't get to pre school. So far, I have not been indited yet and nobody seems to be able to help me with my liscense or tell me what is going on. What are my options? I lost my job and my wife can't drive due to her seizure disorder.
If you were incarcerated for 11 days, that should justify the delay in sending the ALS hearing request. Get an attorney...
I was convicted of a dui in TN in 1999 with a 0.3 BAC, I was arrested in a dry county. I paid all my fines and completed my community service within the time specified. I was and still am in the US Army. After I completed my requirements i was deployed to Korea for the next year. 2 Months ago I got a letter stating that I would have a warrant for my arrest if I did not contact the sheriffs office. Upon doing so they told me that i did not contact my probation officer like I was told to and they have not been able to contact me until now (even though I am still in the Army). They want me to complete another 40 hours of community service and pay a court fee. Because this was 14 years ago I no longer have the records to prove myself. Can they do this or should I try to fight it?
I advise that you direct this to TN criminal defense attorneys. Notwithstanding, based on your facts, you may be able...
When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.
It appears you are working with the DDS provided form. You are not required to give the facts requested. My advise is...
my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?
The legislature decided many years back to enforce a harsher license suspension for people who refuse to submit to a...
Is Ambien a standard prescription drug that the GBI will look for in a Blood test involving a DUI under the influence of Alcohol
I was arressted for DUI for Alcohol. I submitted to a Blood test because the breathalizer was not registering anything. However, I did take Ambien and apparently woke up from my sleep and went for a drive (sleep driving) and then was pulled over which resulted in my arrest. I think I might have told the officer that I had taken Ambien but don't really remember. However, I would think that if I did tell him then it would have been noted in the citation but it wasn't. Only Alcohol was cited as the reason for the arrest and blood test.
If there is no alcohol on your blood and if the officer asked the GBI to conduct a drunk analysis, then the GBI will...
I was arrested for DUI in georgia in 2009 and the case was dead docketed. Arrested again 1 year later and the second time I was convicted. I complied with all of the legal obligations (probation, etc.) However, I got behind on my probation fees due to my inability to obtain employment. Wanted to leave GA to seek employment elsewhere. I elected to do the remainder of the sentence in jail so I could legally leave the state.. Now it shows up as a violation of probation. Can I get the VOP expunged? I was violated simply because I couldn't pay. My question is does the first arrest show up on a criminal background check as a conviction? I checked the county court records for the first arrest and it shows up as "closed" in 2010. (Dated before the 2nd arrest and conviction (no further activity)
The first arrest should not show as a conviction, and under Georgia's new expungement laws you should be able to...
I am a paraplegic who can't urinate on my own. I wear a condom catheter because my bladder spasms can i request blood test?
I am afraid that I will get in trouble because I smoked the week before court I got out of jail about a week and a half ago and have not heard anything from probation. I was told I would be given random tests and even told my lawyer that I had smoked recently he said he would ask the judge for an exception to wait 30 days to give me a chance to clean my system. I never heard this at my sentencing and was taken to jail. Can I request because I am unable to urinate on my own for a blood test? I cannot use catheters due to damage and pain but my bladder spasms and empties itself but mostly at night time.I am in a wheelchair and am deathly afraid of going back to jail. Anyone know if I can request a different type of test? I am also on pain management and take meds they cannot take that right
