Dawsonville Law

I was convicted of a dui in TN in 1999 with a 0.3 BAC, I was arrested in a dry county. I paid all my fines and completed my community service within the time specified. I was and still am in the US Army. After I completed my requirements i was deployed to Korea for the next year. 2 Months ago I got a letter stating that I would have a warrant for my arrest if I did not contact the sheriffs office. Upon doing so they told me that i did not contact my probation officer like I was told to and they have not been able to contact me until now (even though I am still in the Army). They want me to complete another 40 hours of community service and pay a court fee. Because this was 14 years ago I no longer have the records to prove myself. Can they do this or should I try to fight it?
I advise that you direct this to TN criminal defense attorneys. Notwithstanding, based on your facts, you may be able...
Finding no alcohol or drugs, I was arrested for DUI drugs. The reason I did poor is due to my previously broken femur bone. My miranda rights were not read and no one informed me that by refusing to give urine aren't blood, that I would lose my liscense for a year. I aslo was not informed that I have 10 days to get a permit to drive to and from work and appointments. I was incarcerated for 11 days and missed that grace period. My wife has a brain tumor n seizures, plus I have a 4 yr old that we can't get to pre school. So far, I have not been indited yet and nobody seems to be able to help me with my liscense or tell me what is going on. What are my options? I lost my job and my wife can't drive due to her seizure disorder.
If you were incarcerated for 11 days, that should justify the delay in sending the ALS hearing request. Get an attorney...
When I was arrested for DUI I submitted to a breathalyzer and blew over the legal limit. I am now attempting to compose a hearing request but I am a little thrown off by the "statement of facts upon which the contested case arises" and "a statement setting forth the relief sought." I'm not sure how much detail/explanation is expected of me and I don't want to provide too much or too little. I cannot afford a lawyer and I can't find any guidance on composing the request myself. I know that there's only a 10 day window to request a hearing and I'm running out of time.
It appears you are working with the DDS provided form. You are not required to give the facts requested. My advise is...
my husband was arrested for DUI because he refused to take field soberity tests, breathelizer, and BAC after the officer stated they were zero tolerance. He and I did have 2 and 1/2 beers over 3.5 hour and dinner. After they arrested my husband the officer that stayed with me because I refused tests as well kept asking me to take the hand held breathilizer. I finally did and blow a .03. He was happy because now he could leave me. but if they are zero tolerance why was I not arrested and allowed to drive away?
The legislature decided many years back to enforce a harsher license suspension for people who refuse to submit to a...
also I wasn't on a road I was in a friends yard. and the call had nothing to do with that. me and my gf were arguing and turns out after I was hauled off to jail they find so called marks on her which she blatantly denied. so I was not only charged with a "dui" but also simple battery!!!
The DUI law covers every square inch of the state. Doesn't need to be on a road. Arrested for the "suspicion of DUI"...
I had one court date approx. A month after I was arrested. I have heard absolutely nothing since.
I would be shocked if you don't have a warrant out for your arrest. When you went to your first court date, what did...
I was stopped at a road block. I first provided a blood sample and later asked for the Breathalyzer as an independent test about 45 mins after my arrest. If it was reduced to reckless driving, would I be able to have the DUI arrest expunged from my record? This is a first offense with no previous record.
It is a possibility that your case can be reduced based on the limited information that you have provided. What the...
