Very likely will be pleading guilty to second DUI high blood alcohol Level DUI in summit county Ohio and face 20 day jail. Will I have any flexibility for serving jail? Will a judge possibly let me wait to serve the time for jail in 5 or 6 months or is that not possible? I am worried about not having enough vacation days available at my job. Also, is the house arrest option and only 10 days of jail given very often? I am likely facing 20 days jail. My last question is can the judge split up jail days so they can be served on weekends? I am confused about two details so far in a case. First, the arrestee complied with officers requests for field tests and submitting to a breath test. The arrestee had athsma and asked to speak to a lawyer before taking a breath test and asked if alternative tests were available. Officer refused both requests, and the arrestee sincerely tried to produce a breath sample twice. The machine produced an "invalid sample". The officer said this was a "refusal." Was it? Second, because it was "refused" the officer seized the arrestee's out of state ID and sent it to the local DMV as an immediate Administrative License Suspension. Did the officer rightfully seize the out of state ID? Or should state driving privileges only be up for review (and the arrestee be allowed to keep ID)?

This would have been my third DUI (First in 2001 in California, Second in 2003 (2 months prior) in Ohio). I was arrested and given an OR, but never went to court. Instead I moved back to California to go to rehab, had some more struggles, but have been sober since 2006. I haven't had a DUI since. DMV in California has given me my license back, but they claim I need to clear up this charge in order to renew my license. I no longer have any ties to Ohio (I was only there for college), and live a completely different life now. I know that I need to clear this up for many reasons, but I don't even know where to approach it,being that I live out of state. Do they do alternative sentencing for people who live and work out of state? Also have a failure to pay fines warrant from prior dui.

I was sentenced to 270 days in May. It has been 155-160 days so far. I was thinking at the end of November around 200 days to go to the judge and request for early release. How often does this happen? I am a grad school student, I don't care about drinking, I just got unlucky with my 2nd dui. Both DUIs were under .11 BAC. I had rid myself of the people who pressured me into drinking and only surrounding myself with people who help make me a better person. Having the bracelet on has limited me in a few areas especially school and work so that is the main reason I am requesting early release.

I have court June 13th, just had pretrial last week. Plead not guilty. My car has been immobilized for a few weeks now it will be 35 days on June 13th.
