I've completed all diversion requirements except having an interlock device in my vehicle for 1 year (installed, but a year has not passed yet). Back in November 2013 I pled to Guilty to 2 counts of DV assault 4 felony and 2 counts of tampering with witness and got 61 month downward departure and 3 years supervised probation. I've never had a criminal record prior. I've done above what is required by the court and dhs. Unfortunately, I got a duii last week and I'm thinking that I will have to serve the 61 months now.
