My son was charged with simple possession on 2/7; then DUI (not alcohol but pot) on 2/14--I bonded him out for that one; then 2nd DUI (again smoking pot) and another simple possession on 3/8. I did not bond him out for this one. He has not been to any hearings yet for any of them since it has all happened in about a month. Since I did not bond him out for the 2nd DUI how does the 10 hold apply and one DUI was in Humphries County and the 2nd DUI was in Dickson County. He has no money so he will need to ask for public defender--how does that work? If first court date for the 1st DUI is set for 3/19 which is close to the 10 day mark but it is in Humphries County and he is in jail in Dickson County. Unfortunately, I do not have the money for an attorney but am confused how it works.
Different jurisdictions in Tennessee interpret and implement the "10 Day Rule" differently. The rule is designed to...
My boyfriend was on probation for driving on a suspended revoked drivers licenses. Its his 5 offence. We tried to get him back and forth to his po. But the car broke down and due to the economy we both lost our jobs. The po office is 15 miles away or better a little more than walking distance. How could we get his probation reinstated?? And would it do any good if we paid off probation fee's and court cost in advance?
Assuming your boyfriend was represented by an attorney on his underlying charge, speaking to that attorney is a good...
i want to turn myself in. i live and own my home here in tn but warrant is from pa for 3rd dui i got 15 month sentence but ran and it was stupid to do so but i couldnt handle matters i had then while incarcerated. lawyers have told me if i was to get picked up by police here in tn that pa wouldnt spend the money to exdradite back to pa cuz its misdemeanor warrant and not high profile enough, but i really want to take care of this. would i be able to get a reduced sentence to serve my time here in tn? can a lawyer work out some kind of agreement like that with the courts? really want to put this behind...thank you
NO. You are going to have to go to PA to serve time. TN has no dog in this fight.
i want to transfer my pennsylvania state id (not license) to tennessee but i have a misdemeanor warrant for 3rd offense dui in pennsylvania. when i go to transfer it at tennessee dmv, will the warrant show up and will i be arrested?
Quite possibly. You will eventually need to address this issue in Pennsylvania. The longer that you wait and put this...
I financed a vehicle and had my full coverage insurance dropped because my co-signer, whose name was applied as co-owner, has a suspended DL for DUI. I had no idea that the co-signer's name would be applied in this way when I purchased the vehicle. Furthermore, had I known that the co-signer was not insurable, I would not have purchased the vehicle in the first place. Since I cannot insure this vehicle, the loan will go into default and the vehicle will be repossessed. I cannot re-finance the vehicle myself, so I cannot have the co-signer's name removed. Do I have any recourse other than biting the bullet on this one?
If you can sell the car for more than owe you are in the clear.
Arrested for DUI. I was weaving (dropped items in the car and weaved) and also failed portions of the field sobriety test (eye test and one balance test). I was extremely nervous. Never experineced anything like this before. No alcohol and no illegal drugs in my system but I do take 20 mg of paxil daily. I told the trooper but do not know if he recorded this information or added it to his report for testing to use against me. Will the blood test look for this prescription med when testing? I have read it is possible to have a DUI arrest enforced even when prescribed medication is taken in its prescribed dosage.
It's doubtful they would detect the Paxil unless they specifically looked for it. In my experience, Paxil does not...
It is her 3rd DUI in 16 months - she refused the "deal" and now has court / trial next week. She has been running wild for 3 years - walked out on all 4 children ages 2-6 and puts on a great front in court... she always seems to get out of everything... failed drug tests while on probation, no place to live, bounces kids all over the place but DCS wanted to keep giving her chances.. meanwhile she got off probation in April, for the 2 DUI's and got 1 DUI and 2 driving on revoked in a few months - she never installed her interlock and continues to still drive the kids around... how do people like her keep avoiding jail and what can be done so she has consequences before she hurts her kids or others in her path....DCS was certainly was no help. if convicted, how long till she goes to jail
I doubt she'll walk away from this. Keep in mind though that we are criminal defense attorneys here and not...
