If I cannot afford a lawyer and I am charged with a dwi should I plead guilty or not guilty at my arraignment?
I am asking because I do not get a lawyer until the arraignment and would like to have some sort of "bargaining power" when it comes to my sentencing. Also, what am I looking at in terms of "punishment" and is it possible to avoid losing my license? I have a previous dwai and both offenses occurred in westchester county.
If you are indigent the court will assign you a public defender.
I was recently convicted of DWAI in New York. I also attended a hearing at the DMV because I refused to take the breathalyzer when I was arrested. After the hearing, the DMV took my license away for a year based on my refusal. Can I get a conditional license? The woman judge hearing the case was really mean.
You can apply for the conditional license in light of the plea.

I got a DWI and blew a .14 last week at a State Police check point in Port Chester, NY. Although I've done a lot of research I cannot seem to justify the $3-5K for a lawyer when my case seems pretty cut and dry. I've been told I can most likely plea down to a DWAI and take the necessary classes. Can a private lawyer really do a great deal more than a public defender? Thanks!!

I received a DWI on the date of 1/6/11, convicted on 7/13/11 and sentenced to 3 years probation on 12/5/11.
You start by discussing it with your Probation Officer. If that doesn't get you anywhere you make a motion before the judge.
I was in a scuffle a while back and in Westchester..Long story short, my friends were slightly intoxicated and a fight started..
I do not know who instigated the fight as I was not there.. However, as I approached the parking lot.I saw that my friends were being hit, kicked (While on the floor). I tried to stop the fight..(As we were outnumbered) And I was hit in the side of the face. (Blindsided)..Later , after tumbling onthe floor and being kicked myself..I got up only to realized my friends and I were bleeding from injuries..Soon thereafter, the assailants left right away, together..But about a minute or two after..Someone came back from their car with a pistol and pointed it at me..I do not remember/recall who this person was or what they looked like, also because this happened at night and the parking lot was not well lit..I was thinking about filing a report with the local police dept although it's late now.

I have seen videos on you tube of dui checkpoints. And in the videos, the driver of the vehicle does NOT answer any questions
To the officer after the officer asks: "have you had anything to drink tonight" . The driver in the video is recording the interaction and says to the officer "Are you detaining me" And than after being asked questions answers: "I have the right not to answer any of your questions" And continues to ask the officer: What is your officer name and personnel number? The officer calls his supervisor over and says to him: "He is refusing to answer any questions".. The supervising officer walks over and asks the driver the same questions...AS IF trying to force an answer..He, the driver still does not answer. Eventually the officer(s) says "You have a good night sir" .. I see that this can be a legal way to possibly avoid a dui, dwi etc..Am I correct or what are depending factors?
I assume the police did not smell alcohol. If they did the driver would have been arrested whether he answered...
