So i have read about MD expungement of DUI's and I am a bit confused. 7 Total charges: 6 NOLLE PROSEQUI Charge: Article:TA Sec:21 Sub-Sec:902 Para:A2 Code: Description: (DRIVING, ATTEMPTING TO DRIVE) VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL PER SE Plea: GUILTY Disposition: PROBATION BEFORE JUDGEMENT with supervised Probation. Completed all requirements, fees, alcohol class, MADD, and probation. Have not reoffended. I originally read that DUI's can never be removed in MD, however on this site I found a post that says a PBJ DUI can be expunged 3 years after the disposition date. Does the guilty plea matter or change the rules? Am I still eligible for the expungement?
The expungement statute specifically prohibits expungement of DUI findings.

My Husband was hit by drunk driver , his car is totaled and he is in a great deal of pain. What do we do now??
On August 12th at appropriately 2:30AM my husband was hit by a drunk driver . He is 72 years old with previous neck problems. He was transported to the Baltimore Washington Hospital Center and diagnosed with a whiplash injury, a contusion bruise to the knee as well as a concussion. His 2012 Chevrolet Malibu is completely totaled and he is in great deal of pain. I received a DWI/DUI in Jan 2001; I refused the breathalyzer and license was suspended. I was later convicted of the DWI in Mar 2002. I just received another DUI/DWI charge a few days ago and took the breathalyzer - blew .12. Am I facing a 45 day suspension or a 90 day suspension? This would be my second offense of dwi in the MVA eyes but the statute is a little misleading. It states that the second offense of a breathalyzer greater than .08 results in a 90 day administrative bac suspension. I knew that refusing the breathalyzer would be an automatic 1 year do to my prior so either way is better than that. This is really only the first time I actually failed the breathalyzer with a .08 or greater so I am a little unsure.

Maryland MVA hearing for 2013 DUI. I was convicted but maybe eligible for pbj based on a pending motion for reconsideration.
The only reason I was unable to get pbj at the trial was due to a Federal DUI conviction (US Park Police - I-295) on my record from 2007 which carried 0 points and was not sent to MVA. The judge said she would reconsider granting pbj based upon completion of 6 months of supervised probation, and 26 weeks of drug/alcohol classes. Now MD MVA is trying to suspend my license for another 180 days (currently half way through initial 180 day suspension) based upon the 8 points connected to the conviction, however if pbj granted 0 points on my license. All legal parties seemed very confused by Federal DUI and I fall in some legal grey area for probation before judgment. I am unable to join interlock program since I no longer own or have access to a vehicle. What can I expect at MVA hearing?
