When I was stopped for a dui there was the initial one cop who pulled me over but he had someone else in his car, he was not in uniform nor did he have a badge, when I was taking my blood test I specifically remember he was talking to one of the nurses and he said he was a truck driver. who was he and why was he there? and should have he been talking to me? he asked me if my parents are going to give me hell and told me some story about when he was in the vietnam war.

He was probably doing a "ride along" but I cannot be sure.

I refused a chemical test on the side of the road and in the back of the police cruiser without talking to a lawyer. I was taken to jail. Before I was booked I told the officer that I consented to a breath test. He told me that he had already given me enough chances and that he would not allow it. Then he asked me to sign some express consent form and I refused to sign it without a lawyer because the refusal box was already checked. I am just wondering if there will be a chance for me to bring this up at my DMV hearing and maybe save my license. I learned from a previous post on this site to apply for a hearing so that's what I did. My report even says I consented at the station but the officer had already given me enough chances. So I got pulled over the officer had some calls about possible drunk driving, he found a bag of marijuana in my car he then took me to the back of my car and asked me if I had anything else I came clean about everything. he then had me take a field sobriety test which I failed then gave me a breathalyzer which I passed. he then cuffed me and told me I can choose to take a blood test and I told him yes I will and put me in his squad car.
