When I was stopped for a dui there was the initial one cop who pulled me over but he had someone else in his car, he was not in uniform nor did he have a badge, when I was taking my blood test I specifically remember he was talking to one of the nurses and he said he was a truck driver.
who was he and why was he there? and should have he been talking to me? he asked me if my parents are going to give me hell and told me some story about when he was in the vietnam war.
He was probably doing a "ride along" but I cannot be sure.
I was arrested at a checkpoint for suspicion of DUI last August. I plead guilty to a DWAI in December of 2012. Before I plead guilty, I received documentation from the DA's office of an investigation into inaccurate blood test results from the CDPHE. Mine came back at 0.11. Recently, I came across an article about ongoing bias and poor training at the CDPHE. Is it worth my time and money to try and overturn my conviction using the bias, poor training and history of inaccurate results? Or am I better off just filing for early termination (in good standing, all conditions have been met, no failed UAs)? Do I risk facing additional penalties if I fail to overturn the conviction?

If you had an attorney, consult with that attorney. If you did not, then find one to consult with. The only risk would...
I refused a chemical test on the side of the road and in the back of the police cruiser without talking to a lawyer. I was taken to jail. Before I was booked I told the officer that I consented to a breath test. He told me that he had already given me enough chances and that he would not allow it. Then he asked me to sign some express consent form and I refused to sign it without a lawyer because the refusal box was already checked. I am just wondering if there will be a chance for me to bring this up at my DMV hearing and maybe save my license. I learned from a previous post on this site to apply for a hearing so that's what I did. My report even says I consented at the station but the officer had already given me enough chances. Any help would be greatly appreciated!
The best advice I can give is to talk to a DUI attorney. So many issues can arise in these types of cases and they are...
So I got pulled over the officer had some calls about possible drunk driving, he found a bag of marijuana in my car he then took me to the back of my car and asked me if I had anything else I came clean about everything. he then had me take a field sobriety test which I failed then gave me a breathalyzer which I passed. he then cuffed me and told me I can choose to take a blood test and I told him yes I will and put me in his squad car. I went and got the blood test done and the officer called my parents and took me home.
Miranda warnings are only required if the officer plans on using any of your statements made to him against you in...
Ok I had a interlock in my car last year. My car was broke down and I didn't have the money to fix it. I took it to the juck yard. Called the DMV,interlock company that same day. I have poof of calling them. I have been out of work. Then I had two hearings last month. The first one the hearings officer said that he didn't have my proof. Then I called his suppervisor and he told me that he will tell him where my proof was. A week later i have a hearings and the officer said since keeped the interlock 2 months after I got rid of the car cuz I was out of state. I was guilty of 42-2-132.5 I just got a job. I want to fight this in appeals court and to be able to get a car with a interlock. So how hard would it be to win in court?
