I had gotten a dwi and auo2 they gave me 5 days in jail instead of 3 years probation and a year conditional discharge the district attorney said I would only be in jail for 3 days of the 5 is this true?
You do 2 days for every 3 of the sentence so 3 sounds right.
My mother-in-law was arrested for DWI and resisting arrest about 6 months ago. She went to trial and the jury deadlocked on the DWI charge and she was found guilty on the resisting arrest.How can the resisting arrest charge stick, if the DWI charge ended in a dead lock. I am just curious, because she was just sentenced to 8 months of jail time. BTW the original charge DWI was deadlocked because she drove an ATV across her land to her brothers house when the police where at his house, so it wouldn't constitute a DWI if she was not on a public road.

it will be my word against the state troopers word. many things just do not make sense nor add up, and their are other circumstances or variables if you will that are involved. The arresting state trooper has already lied and omitted pertinent information. the road side thing that i blew into had a reading of 0.169 (the state trooper showed it to me) and was as he stated to me that I would only be getting tickets for agravated unlicensed operation and unsafe lane change. As we were ready to go to the state police building did he then state that I was also being arrested for DWI. I refused a test at the state police building. We havent any monies for an attorney and the public defender I question whether or not can take on a case like this.
