Is there statute of limitations on re-serving a DUI ticket after it was dismissed without prejudice? This is for Commerce City, Adams County, Colorado. I was given a summons for DUI, Reckless Driving, and Disorderly Conduct on February 22, 2011. When I appeared for the court date on April 22, 2011, it was dismissed by the county clerk without prejudice because the officer failed to file it with the court prior to the court date. The dismissal states that the officer may choose to re-serve with a new summons. I have moved and don't want to return until I am safe from being re-served. Is there a statute of limitations on this re-service? Can the DUI reactivate after it was dismissed? Can the officer be reprimanded for failure to file original or to re-serve me? He was visibly upset according to witnesses when he tried and found I was gone. Should I hire a DUI defense attorney?

I refused a chemical test on the side of the road and in the back of the police cruiser without talking to a lawyer. I was taken to jail. Before I was booked I told the officer that I consented to a breath test. He told me that he had already given me enough chances and that he would not allow it. Then he asked me to sign some express consent form and I refused to sign it without a lawyer because the refusal box was already checked. I am just wondering if there will be a chance for me to bring this up at my DMV hearing and maybe save my license. I learned from a previous post on this site to apply for a hearing so that's what I did. My report even says I consented at the station but the officer had already given me enough chances. Any help would be greatly appreciated!

It seems that it would boil down to my word against the officer. He states he smelled a strong odor of alcohol I spoke with a heavy tongue and had bloodshot and glassy eyes. There was no alcohol or blood test. How strong is this evidence he has against me?

I was leaving downtown Denver and was pulled over for speeding (54 in a 35). When asked out of the car and asked to do roadside test and breathalyzer I refused, including giving blood. Will this give me any shot of a reduced charge, ie wreckless driving? I was never in front of the officers dashcam during this, yet in his paperwork he stated that I was swaying and my eyes were red and watery, with slurred speech. Do they have to have evidence of intoxication for a DUI charge? If so, how would they get it with no weaving or BAC?

I was on probation for a dui for over a year, when it was revoked because I missed a meeting with my po and didn't reschedule. I kept going to my classes, but they were not getting news of it. My probation was reinstated, but with a new full term 2 year probation sentence. My question is, can they do that? Can I get anything for 'time served' being on probation for over a year before they revoked it? I know the maximum probation sentence for a 2nd dui in Colorado is 2 years. (This is a 2nd offense). First ,officer asked me to do balance test. Express consent affidavit and notice of revocation says I had odor of alcoholic, Eyes had bloodshot and were watery and Speech was slurred. Balance was marked as other but officer didn't write why its marked as other. I was contacted for no headlights/ failed to drive in one lane. My eyes are always red because I wear contactlenses and make my eyes dried and watery. I have a strong foreign accent maybe thtas why the officer tought I didnt speak clearly.
