No accident. Blew a .11 at the station. First offense. Clean criminal record. Clean driving record. Was very compliant with the officer. He told me upon dropping me off at my house after everything was done that it is likely that I would get a reduction since I blew under the .13 threshold for the county, and that he "sees it all the time." Still cant help but worry. I have hired an attorney as well.

II YRS.AGO, I WAS CONVICTED OF FELONY DWI. IN UPSTATE NY. DID 5YRS PROBATION, NO JAIL, $5000 FINE. NO PROBATION VIOLATIONS.CLASS E FELONY. NOT EVEN A TRAFFIC TICKET SINCE. I WAS AN AVID SHOOTER, SHOT AT TWO CLUBS REGULARLY. I WOULD LIKE TO DO THAT AGAIN. DO YOU THINK IT'S POSSIBLE? SHOULD I GET AN ATTORNEY. WHO WOULD SPECIALIZE IN THIS? THANK YOU.

They said they would wipe the arrest records clean of my first charge, it wasn't an ACD, I plead guilty for Disorderly Conduct. I was arrested again last night for petite larceny, will they over look the first one since I plea guilty to a violation or is it viewed as my second criminal offense and my first arrest is considered too? If so what is the likeliness of jail time? Also both times the merchandise was under $20. I would like to go to rehab, I have a drinking problem and I'm only 21.

Five years ago when I was 19 I got in an accident after drinking and injured my passenger. They postponed the court date so I could keep my license, as I was driving to college and work at the time. Now, five years later, my lawyer called me saying they want to bring it up again. I now live in another state, graduated with my bachelors, and have a full-time job of which I have no time off. How is this not a violation of the statute of limitations? Or at least a violation of my right to a speedy trial? There is no way I can travel 14 hours to sit in traffic court for something that happened so long ago.
It's not traffic court. They have 5 years to prosecute a felony depending on the arrest/arraignment situation. Speak w/...
i was charged on 07/20/11 with dwi, refusing a Breathalyzer, i was scheduled for trial in may 2012, postponed judges brother past, scheduled July postponed stenographer sick, scheduled sept, postponed just thought agreement was made judge sent jury home, sent application for license paid $1250 civil penalty & $100 app. fee to dmv pleaded guilty to wreck less driving DEC. 05 2012, received a denial notice 03/08/13 for life for priors, i have one dwi convictions and 2 dwai convictions in 36+ yrs of driving but also three refusal to submit to Breathalyzer, what is my next recourse ? can i sue dept. of motor vehicles ? i paid that $1250 and $100 app fee with the assumption i was getting my license back also paid my attorney thousands to get dwi reduced to wreck less driving

I got a dwi in 2009, and a second one while license was revoked in 2010. The second was a felony. And currently on Probation. I stopped drinking , i dont do drugs and have two boys. I have full time job and stay out of trouble, but i couldnt find a ride to get my step son today so stupidly decided to just go get him. I got pulled over for "loud" exhaust, i recieved unlicensed operation, fix it ticket for exhaust, driving without Interlock system, and failed to notify dmv of address change. I know I messed up but what should i do now and what am i looking at for the worst and least that could happened. The state trooper let me go after my friend showed up to drive my car.
You have to get an attorney to handle these charges and the likely VOP. A judge can just restore you to probation but...
