I blew a .2 for this third offense so I know there is a mandatory 90 days. Is there any way I can get out of a conviction and if convicted is there mandatory jail time since it would be a Class 2 felony? Also, could I possibly receive probation, work release, or house arrest?
Difficult to say if you can "get out of it". Some jurisdictions will agree to a misdemeanor and suspended sentence....
My last conviction was over 10 years ago and the Secretary of State sent me a letter approving me for a MDDP because I'm considered a first offender. I have not been convicted of my third DUI yet, but once convicted will they cancel my MDDP?

When the judge is considering sentencing for multiple DUI does he/she count just convictions or both conviction and supervision. EX: 1 supervision DUI (24years ago) and 1 DUI conviction (11 years ago) and now 1 arrest ....will it be sentenced as 2 DUI or 3 DUI...
