I am on probation for a DUI. My probation is over June 2013. Last night I was cited for Public Intoxication. Will I violate?
Additionally, I was arrested in May for drug possession and incarcerated for 2 weeks until the detainer was lifted. I fought the charges and won and only received a disorderly conduct. My PO removed the violation so technically I do not have any violations since I began probation in 2008. Should I tell him or will he not even find out because it is a summary offense? Should I fight the charge? I don't think it makes sense to fight it since he can violate me if he wishes just because I was arrested, regardless if I am found guilty. I have a lawyer that I worked with previously, but I was looking online for more help. I look forward to someone's advice.
It depends on what the rules and conditions of your probation are. I would not count on your PO not hearing about it.
How does that 10 year look back period for pa dui laws relate to people that had dui prior to the new law?
I got a dui in 1994 and went thru the ard program. I got a dui in 2004 and the new law states it can look back 10 years. I was told that my first dui was going to be expunged from my record in 7 years from the judge.. the duis were 9yrs and 8 months apart
I'm a bit puzzled why you're asking about a DUI in 2004, but to answer your question, the 2004 DUI would definitely be...
Is it possible to get a 1994 DUI conviction expunged
i had aDUI in 7/1994 and went through the ARD program. I also got a DUI in 3/2004. Im hoping to get this expunge for i would like to enter the police academy. Since my last DUI, I have joined the military and i'm currently deployed to iraq. I had paid all my fines and served my time for my DUI conviction since it was not after ten years before entering the military. I was hoping to get this infraction off of my criminal record. I also was wondering that since my first conviction was in 1994 wouldnt i fall in the old rules when your arrest would of went off the record after 7 years?
The first DUI would be expunged upon motion after successful completion of ARD, but even that is somewhat misleading....
Dui conviction vs Dui (Ard Disposition)
I have a dui controlled substance charge. I likely qualify for ard because I have no prior misdeameanor or felony convictions. While on ard, I have to wait a year to get it expunged from my record. I have a bachelor's degree and I am driving myself crazy thinking how this charge mat affect me finding a decent job for the time being. I know ultimately every employer is different but I feel it would be more acceptable if it was a simple alcohol dui but no legit company wants a druggie even if it's not a conviction but a ard disposition. Am I thinking too much into this a shot just apply for jobs because at the end of the day it's not a conviction (and never will be) and jobs only care about convictions? Or is this something I should genuinely be concern ed about? Or is this
Employers care more about JUST a conviction, they care about a course of conduct. Thus, even it's imperative you do...
Will DUI controlled substance charge be a barrier to finding employment with Bachelors Degree?
I have a Bachelors Degree from Temple University. I think I have a good chance of getting ARD with no prior misdeameanor or felony convictions on my record. My concern is for the next year and a half how will the charge look to a potential employer. I'm a minority so my odds of getting a job in my field is lower without a criminal charge according to (http://www.pewresearch.org/fact-tank/2014/08/06/the-job-market-tightens-but-new-journalism-grads-remain-upbeat/) I know most jobs only ask for convictions but how much do you think the charge will be a barrier from me finding a job.
With no disrespect intended, I think you are asking the wrong people about the future employment ramifications of your...
Can you surrender PA driver's license before ARD court starts?
I was caught and being charged as first time offender high BAC 0.10 last year. Now, I received the letter, after gone through pre-trial conference, that is related to ARD program. I know that my license will be suspended for a period of 1 month. This starts in July of 2015, but I would rather surrender my license earlier (like in the middle of May) if that is possible. My question is can you surrender license before ARD program even starts?
You can surrender whenever you want but your suspension won't begin until you are accepted into the ARD program.
Can I become a paralegal with a DUI and a paraphernalia charge?
I got a DUI about 6 years ago, and the paraphernalia charge about 2 years ago. I will be off probation next month and I want to go to school and become a paralegal, but I don't want to waste my time if there is no chance I would get hired. Any advice on this matter would be greatly appreciated. Thank you
Your convictions probably will not prevent you from becoming a paralegal, but they could cause some difficulty when...
