Additionally, I was arrested in May for drug possession and incarcerated for 2 weeks until the detainer was lifted. I fought the charges and won and only received a disorderly conduct. My PO removed the violation so technically I do not have any violations since I began probation in 2008. Should I tell him or will he not even find out because it is a summary offense? Should I fight the charge? I don't think it makes sense to fight it since he can violate me if he wishes just because I was arrested, regardless if I am found guilty. I have a lawyer that I worked with previously, but I was looking online for more help. I look forward to someone's advice.
It depends on what the rules and conditions of your probation are. I would not count on your PO not hearing about it.
I got a dui in 1994 and went thru the ard program. I got a dui in 2004 and the new law states it can look back 10 years. I was told that my first dui was going to be expunged from my record in 7 years from the judge.. the duis were 9yrs and 8 months apart
I'm a bit puzzled why you're asking about a DUI in 2004, but to answer your question, the 2004 DUI would definitely be...
i had aDUI in 7/1994 and went through the ARD program. I also got a DUI in 3/2004. Im hoping to get this expunge for i would like to enter the police academy. Since my last DUI, I have joined the military and i'm currently deployed to iraq. I had paid all my fines and served my time for my DUI conviction since it was not after ten years before entering the military. I was hoping to get this infraction off of my criminal record. I also was wondering that since my first conviction was in 1994 wouldnt i fall in the old rules when your arrest would of went off the record after 7 years?
The first DUI would be expunged upon motion after successful completion of ARD, but even that is somewhat misleading....
My first DUI was in 2012 in Montgomery County and my probation just ended May 2014. But i got charged with a 2nd DUI on Thanksgiving of this year (2014). I'm just scared because i'm graduating May 2015 and I want to get employed to a good company. I also work to pay my own rent and bills so I don't want to lose my license or go to jail. I'm not positive, but i think my BAC will be between .08 and .09. Please if anyone can help i would appreciate it. Also, are police officers allowed to make you take off glasses when doing field tests?
A 2nd DUI within 10 years is an ungraded misdemeanor with a mandatory jail sentence of 5 days to 6 months. There is...
i previously lived in florida for 3 years to get help for a substance problem all 3 years i remained 100 percent sober, and this would be my reason for going back. i have a lot of support and resources to help me live a clean and sober life down there. meanwhile in PA i cannot get it together. iam currently in the process of the probation getting transferred, but it takes a while and iam afraid i wwont make it that long.
The most obvious ramifications is that your probation could be revoked. Why not talk with a local lawyer and see if...
First offense. No accident. I was given a Blood Test (not sure why). I had no drugs (other than Tylenol) in my system. I was released via ROR, and an A.R.D. was explained to me before I left jail. I don't know my BAC; is there a way of retrieving this before my trial? If they offer me an A.R.D, and my BAC was .1%+, what are the chances of me spending time in jail/prison? Do other circumstances weigh on the DA or Judge's opinions for hearings like this? For instance I'm a College and Masters Grad. I own a Small Business.
Retain a local criminal defense attorney who has experience with DUI cases. ARD may be your best option as it affords...
The underage drinking citation was reduced to a disorderly conduct after I went to a few classes. Does this disqualify me for ARD? I was arrested for DUI by the East Whiteland Police Department in Malvern PA.
You won't know until you apply, hire a criminal defense attorney, he or she can contact the district attorney to see if...
