Hello, I was charged with a misdemeanor Dui in July 2010. There has been several delays, the last one was my Attorney suffered a stroke. Since then his office filed and was granted a motion to no longer represent me as he was the only attorney that handled this sort of thing. I received a notice of a trial date in the mail. Over the last couple years I have fallen on hard times and cannot afford another attorney so I went to the pre trial hearing with hopes to speak to the prosecutor for some sort of plea. I did so and was very disappointed with the offer! The prosecutor then told the judge in court that we have a pending deal and if she does not hear from me today we should go ahead with the trial on Tuesday. My question is; is it too late to ask for a court appointed attorney? According to the prosecutor my two options are to take this deal or represent myself on Tuesday. If I am still able to obtain a court appointed attorney, please advise.

Arrested for a 3rd DUI, on probation, released into DUI court. After failing the roadside sobriety test, I refused the roadside breathalyzer saying I wanted to talk to an attorney first. At the police station I was read my rights, asked, "what constitutes a reasonable amount of time" and was told by the officer they would let me know when it was close(never did). Called a lawyer who said they'd call back. Waited about 20 minutes then called another number. Talked to this half asleep attorney for about 15 minutes not realizing it was a phonebook for 150miles away. I asked to call another, was told no my time was up. I refused saying I wouldn't take it until I could consult another attorney. Is contesting worth a shot? Should I worry since my public def. works closely with DUI court team?

I got a DUI and also do to medical issues which i also had taken epi-pen earlier before the arrest, dont they have medical laws that need to be follow? I was initially stopped for my head lights being out. I was traveling in a well lit area, with inside lights that are always on, I could see well enough, so I forgot about the headlights. (bad habit of mine) My BAC tests were .16. I have had a prior DWI conviction at the age of 19. Since then I have had a child, have a good job, and am attending full time RN classes. I dont know if my case is anything more than cut and dry, and if it worth my time to hire an attorney. I would just like to stay out of jail on account of my child.
