trying to come up with the $1000 down. Im out $600 dollars already and its only been 3 days since arrest. I'm worried that I will not be able to pay for classes and court if I don't save now; hoping for getting free counsel my mom bought me a new car right before this but I'm forced to sign it over that was my only asset. Still hoping to file as indigent seeing as I will lose my job once I lose my dmv hearing. and i don't know how I will go to school if I'm in jail. can i plead not guilty and then ask for a pre trial conference giving me two more months.
You may ask to be referred to the public defender's office at your first court date. We offer payment plans which...
About 2 years ago in Colorado at a routine traffic stop I was charged with a DUI and let go. I returned to washington because the police officer told me I could do my hearing over the phone. A couple days before my court date I called the court to find out how to do this hearing. I was informed this was incorrect and I needed to be in colorado in 2 days. So I spent all my money on a bus ticket to colorado for my pre trail hearing (not sure what its called) and excepted a plea deal that involved probation and a reduced charge. I was unable to complete this due to lack of funds. I was homeless with no job. I now have an FTA warrant and just want to know if a lawyer might be able to help with the situation, and what kind of jail time I'm looking at. I blew a .081 if that helps.
Yes a warrant is likely active. Depending upon the jurisdiction and judge, a lawyer can sometimes quash the warrant...
My lawyer talked to the da and said he had a good plea from my dui I received in December. . A Dwai. I had a prior in 1990. From Everything I am looking at I see no difference because of time or offense. As far as sentencing between the two. Why would this be a good deal. I asked my lawyer doesn't seem to be getting a straight answer. Is this a good deal? Do I need a new lawyer? I'm confused and do not see the benefit.
Frequently a prosecutor offers the lesser included offense of DWAI in place of the DUI based on the chemical test...
My brother is 17 years old, and this is his first offense. I'm not sure what his BAC was. I also got a dui and received very harsh punishments but worried about my brother even more since he's underage.
Your brother faces the exact same criminal punishments as you did, except he faces more severe consequences to his...
Drunk driver totaled my vehicle, no injuries. I have accepted but not yet received the settlement from his insurance after months of arguing over the market value of the vehicle. I would lose more in attorneys fees than I would gain by suing the driver in order to get the insurance to pay the judgement for the correct amount. D.A. is requesting restitution to be paid to me for the correct amount, more than his insurance is offering, My question is, can I accept the settlement from his insurance for less and still receive the restitution for the full amount. And am I required to report any settlement I receive from the drunk driver's insurance to the courts.
That's a great question! I would think the restitution value should set the value for the insurance company. Assuming...
I was sentenced to two years probation for a dui involving an accident. I have completed 18 months with no issues during probation except i failed my first three ua's because of marijuana use before I was sentenced. I filed a motion for early termination 90 days ago and it was denied due to 1) the failed ua's for marijuana 2) because the dui involved an accident. What are the chances the judge will allow the early termination (or unsupervised probation) now?
A lot depends upon the judge and when you filed your motion for early termination. If it was the other day then any new...
Have had interlock for 1 year have been locked out 3 times for not retesting , I left car running and got distracted and horn went off and locked me out. I waited 14 minutes and restarted car immediately and then retested several more times right after. I have never had a fail. I just got distracted those 3 times, it seems to me that would be a common error, especially when your older. Have you ever hear of this and what were the consequences?
I have never heard of this in 17 years of practice. Ask the manufacturer of the IID if a report is sent to your...
